Court Rules Doctors Can Ask Patients About Gun Ownership

A federal appeals court has ruled that a Florida law restricting doctors from asking patients whether they own guns restricts the right to free speech.

The 11th U.S. Circuit Court of Appeals found that the law violated doctors’ First Amendment right to free speech, and concluded that the state failed to prove that physicians were infringing on patients’ Second Amendment rights. A previous decision by a three-judge panel by the 11th Circuit upheld the law, but those suing the state asked for the full circuit court to re-consider the case.

The Republican-controlled Florida state legislature passed a law in 2011 preventing doctors from asking patients about their gun ownership and gun safety procedures. Supporters of the law argued that doctors in the state were overstepping their authority and pushing an anti-Second Amendment agenda.

The move came after a Florida couple said their physician had asked about gun ownership and refused to see them after they declined to answer, according to the Miami Herald. The Brady Center to Prevent Gun Violence quickly challenged the law, which has been battled over in the court system for years.

For what it’s worth, even at the risk of committing “Constitutional blasphemy.”

One can only get so much out of guns. But the philosophical triad of God, guns, and guts got that way for a reason. In fact, notice that God is first. Without this God, who as it turns out has a profound benevolent bent, the guns and guts will go to waste.

Oh sure, the Constitution text said nothing about God (except for a hat tip in its dating of “Year of our Lord.”) But this was like fish saying nothing about water, except for how far they had traveled in the water. God consciousness was ever present at the time, in fact to a depth that we might find briefly disorienting if we were to travel there in the proverbial time machine. One would, in fact, be inclined to sacrifice for neighbor and kin rather than for oneself. The self-glorification so characteristic of today would seem mysteriously subdued. But we would be immediately taken with its nobleness.

Who would want to continue seeing a doctor like that? To me if that is his level of reasoning it calls into question his competency in all matters - including medicine.

The problem with answering no is that the overall response rate will subsequently be utilized to justify infringing legislation because “see, not that many well educated doctor visiting right thinking patients actually own guns!”

Took my grandson to the doctor yesterday. Among other things decorating the wall of her office were lots of pics of John Wayne in full gun totin’ attire. If she has time she might even discuss her recommendations for which guns seem to fit females best. But this is in Texas.

I would immediately ask the doctor how many beers, cocktails, smokes as in pot, etc. they have imbibed during the last 24 hours. I know an alcoholic doctor put the wrong hip replacement device in my mother and it was found out by another doctor withjn the year. So sad. There’s a book out by Joel Wallach “Dead Doctors Don’t Lie”. . .I think guns are the least of their worries.

I don’t think many doctors here in Arizona are going to buy into this BS either. It’s a waste of time. “Guns? What’s a gun?” LOL.

The American Medical Association had input into the design of electronic medical records systems just as they did medical coding.
And they had the question “Do you own a gun?” built into many EMR systems as a standard or necessary question.

In theory, if you lie about a health or safety issue to the doctor and thus insurer and then get hurt, your medical claims based on said condition (being shot) could be denied.
It also provides a data collection point where people could theoretically be charged more for health insurance due to the health risk guns pose per liberal logic, just as smokers are billed more. Another financial incentive to try to force change, though I don’t know of any insurer who has done such.
You also get medical data collection such that if you take antidepressants, they can flag your case and demand police show up to take the gun. Unfortunately, some of the anti-suicide calls have resulted in police killing the person they were supposed to save, so I don’t have any faith in that process if implemented on a routine basis.

Since doctors can refuse to see patients they see as a liability risk and are already refusing to see anti-vaccination patients, there may be doctors who want to similarly segregate gun owners.

My answer to anything I feel is intrusive is always......NA. Not applicable. If they argue the question with me I’ll tell them.....explain how that question is applicable to why I’m here and then if you’ve convinced me it’s applicable I might consider answering you. They shut up real quick.

Further to that, never answer any of the probing questions about your mental health. I know it’s lousy not to be able to trust the medical profession, but over the past few years, wht the advent of electronic medical recordkeeping, everyone involved “hoovers up” even the minutest detail about your health, and it allows the government to make “subjective evaluations” about you. The other thing that you should do, is survery your medical records several times a year if you are seeing anyone about a medical issue or problem, because you may find erroneous information has been made a part of your medical record. The other thing that’s really pissed me off is the amount of time devoted to your medical record by your doctor or nurse during a visit. I routinely see half of a doctor’s visit being devoted to data entry. It leave me with the feeling that at the end of the day their interest here may not be in your best interests, as the government has made the medical profession “agents of the state.”
