I am not a lawyer, but having read the decision, I think it is pretty clear and a lot of people (including FREEPERS) are overstating the gravity of the ruling. Not for one minute is the 9th Circuit denying the legitimate authority the president has to deny foreign nationals entry to the US— they have no rights in US courts. They are nitpicking on one aspect of the EO— that due to the broad language of the EO it also has impacted legal immigrants who are permanent residents, with green cards, who are in the process of becoming naturalized citizens and DO have limited rights in the US courts, and has done so without providing a means of due process for them. A handful of these folks were travelling abroad, and denied return without due process. It would be easy to fix this objection by either rewriting the EO to exempt them, or by adding a clause that provides for review in these cases. Any legal eagles out there care to chime in?
Not a legal eagle, but my understanding is that subsequent guidance was given to make room for those people.

There is no valid law that gives them the authority to issue an injunction on this EO.
