Sen. Minority Leader Chuck Schumer (D-N.Y.) said on Sunday that he is prepared to leave open the ninth seat on the Supreme Court.
If the nominee is not bipartisan and mainstream, we absolutely will keep the seat open, Schumer told CNNs State of the Union.
ADVERTISEMENT The Supreme Court vacancy has been open since last February, when Supreme Court Justice Antonin Scalia passed away.
Schumer said he is prepared to fight "tooth and nail" should Trump not choose a mainstream nominee.

As far as I know, there’s nothing in the constitution which stipulates a super majority or a 61 vote margin to approve a justice to the Supreme Court. I think it only says advise and consent.
I think he should name one of the two women that he announced were members of his short list. No surprises and a woman nominee is harder to demonize. Let Chuckie have his four weeks of nastiness and then confirm her.
If he doesn’t pull someone out of the blue but sticks to his list, he will encourage Buzzie to announce her retirement.

In 2018 in the Senate the Democrats have 24 seats up to the Republicans 8. Worse of those 24, 14 are in states Trump won (10 in states Trump won 55%+).
But there’s more bad news for the Dems, the Republicans with the specter of getting 60+ seats in play their base will already be energized in 2018. For Democrats, however much of their base are the Low Information Gruber type voters who are too busy keeping up with the Kardashians and generally don’t pay attention or show up for “boring” mid-term elections.
So if they value their seats, the last things these 10-14 Democrat Senators want to do is further enrage and energize the Republican base in their states. If they break the filibuster their LIV base will be mad but will ultimately forget about it by the next time Dancing with the Stars is on, if they hold the filibuster the Republican base will most certainly remember and be out in force to vote then out in 2018.
So if they have any semblance of common sense and self preservation, expect a lot of Democrat defections.
Nope. The Constitution doesn’t say 2/3. It gives no number at all. The 2/3 number is for granting treaties.
