The Environmental Protection Agency announced Friday it will not repay claims totaling more than $1.2 billion for economic damages from a mine waste spill the agency accidentally triggered in Colorado, saying the law prohibits it.
The EPA said the claims could be refiled in federal court, or Congress could authorize payments.
But attorneys for the EPA and the Justice Department concluded the EPA is barred from paying the claims because of sovereign immunity, which prohibits most lawsuits against the government.

What difference does it make? It's still "our" money.
FMCDH(BITS)
It is time to lobby senators and representatives to end gooberment sovereignty. It is a wonderful way to cause fear of the people by our gooberment servants.
If they can’t be held liable for the damages they cause they should be shut down.
Can you imagine if this was Trump’s EPA?
I hope the Trump spokespeople emphatically and relentlessly point out their EVERY hypocrisy EVERY time.
"**** you," the government explained.
“But attorneys for the EPA and the Justice Department concluded the EPA is barred from paying the claims because of sovereign immunity...”
We have a legal process for stripping outlaw bureaucrats of their sovereign immunity. Do that, and then sue every eco-fascist EPA pig for every penny they own.
Circular argument. None of these entities are eternal, and they certainly are not sacred to the majority of the US. If they won’t be rolled back, then they are fated for collapse just like the Roman Empire.
“sovereign immunity only protects from LEGAL acts in good faith...it does NOT cover illegal acts or protect incompetence that covers harm to others.”
Exactly right. The EPA nazis can be stripped of sovereign immunity and held legally responsible.
Don’t forget confiscation of pensions.
Seems to be the “lawfare” cycle that the left has set up: start suing everyone except the leftists in power, whom you make “immune”. The leaven of the old assimilating itself into the new, as Jefferson wrote to Spencer Roane in 1819 (paraphrased).
“The political cost for assault is just too great for the trouble and capital expenditure.”
The fascist EPA was created to destroy property rights. (Thank you, tricky Dick Nixon, you POS) While on its mission to destroy American property rights, the EPA Nazis totally screwed up by engaging in outright sedition. (see Rapanos v US for one example)
We need a Congress willing to charge the EPA with sedition, treason and other infamous crimes against the American people.
Take it from their 2017 budget.
It’s called the federal torts claims act, and the EPA can be sued.
All those involved should loose their pensions for starters, never be able to hold a government job in thier lifetime
Absolutely! Cannot pay for damages? We shall then settle for the firing and imprisonment of everyone involved in the this idiotic decision. Just like in the real world... pay with consequences.
Is the volkswagon settlement going to EPA? Use it to pay the damages for the spill.

> This sovereign immunity doctrine is nowhere in the Constitution.
And neither is the EPA. It didn’t exist before 1972. Nixon created it to look into Rachael Carson’s “Silent Spring” allegations about DDT and now it has grown to a commie environmentalist monster and DDT was not the culprit.
Can't think of a better time to eliminate the Obama-level incompetence of the EPA.
Fire them all, and blackball them all from ANY future government employment of any kind.
I am dead serious.
If after some time to reflect there is a proven need for a similar agency, then just start from scratch with safeguards not possible to be perverted by future Dems to apply swift and certain serious jail time for criminal negligence or totalitarian petty fascist tendencies.
