I think that isn't a big deal (denial of rehearing en banc) because the issue decided is now moot. All they decided was the two day delay could be circumvented. The 6th circuit volunteered that if MI courts said "no recount," the federal court would entertain a motion to vacate (an improvidently worded) order that covered more than those two days.

From a federal court system view, the ball is in Judge Conehead's lap. If he finds a right to recount in contravention of MI court, the GOP can take THAT decision to the 6th Circuit.

Can someone explain this in lay terms, considering all of the rulings and actors that have been involved, creating just a bit of confusion to the casual visitor?
