The Dakota Access Pipeline will not go ahead at the Standing Rock Indian reservation, it was announced Sunday.

Moments after the decision was announced Cheyenne River Sioux Tribal Council Chairman Harold Frazier told DailyMail.com that he was 'shocked' by the news, which he'd received from Jo-Ellen Darcy, United States Assistant Secretary of the Army.

The camp erupted into cheers as the news spread that the US Army Corps of engineers would not enforce an easement that would have allowed a pipeline to run under Lake Oahe half a mile south of their reservation, potentially affecting the tribe's drinking water and infringing on land rights.

Sovereignty means the right to act as final judge in all disputes, including disputes involving the sovereign itself/himself. The Indian tribes are not sovereign or anything like it, despite what treaties may say.

This was going to be a pipe within a pipe to prevent spills.

Excellent. Very necessary when going under rivers, through wetlands or other sensitive areas.

I expect that decision by the ACE will be reversed in a couple of months. The current folks in charge just kicked the can down the road so they can let someone else take the responsibility and the heat.

If there is a reasonable alternative way, that’s fine. These particular Indians will not receive any payment for a pipeline that is not on their land. Their loss.

One argument was that the pipeline ran under a river. It may sound reasonable at first, but it is not. You just cannot always avoid rivers. Our tens of thousands of miles of pipeline do not go beyond the headwaters of each river, to the other side. They go over, or under rivers.

If an alternative route proves to be too expensive, this topic should be revisited. A new President will make all the difference to the Army Corps of Engineers, if that is his decision.

Oh well. Put it in freight tankers and haul it over the road and let the damn thing explode.

In Montana a pipeline along a river going through Indian land had a history of leaks. IIRC the tribe requires that the product be unloaded into RR tank cars which haul it past the sensitive area controlled by the tribe and then unloaded into a pipeline to continue the journey west to its destination.

I would make the tee pee tippers sovereign on their reservation but block the highways in and out and require a passport and toll to exit the reservation.

It wasn't going on their land in the first place. Unlike the Mandan, Hidatsa, and Arikara and the Trutle Mountain Chippewa, the Standing Rock Sioux have no oil under their land. They do not own the land the pipeline is/was crossing. No, they weren't going to make any money off this. What do you think the entire delay was about? A hold up, in more ways than one.

The tribe has behaved dishonorably in this. I will never spend a dime at their casinos, nor on their land, and will make a point of never hiring anyone from the Tribe.
