The White House refused to rule out Wednesday whether President Obama might grant a pardon to Hillary Clinton to spare her from President-elect Donald Trump prosecuting her after he takes office.
White House press secretary Josh Earnest said Mr. Obama is hopeful that Mr. Trump will follow long-standing tradition of not punishing political opponents through the criminal-justice system. He said all clemency actions go through a formal process...

VA governor Terry McAuliffe used an auto-pen to restore voting rights to 60,000 convicted felons so six pardons by the usurper would be nothing. I bet he'll do it.
I’m sure O’bama will get writer’s cramp with all the pardons he writes.
“Not really” what? What have I stated that is inaccurate?
So apparently running for President is a get out of jail free card.
I asked this on another post, but can Trump UN-pardon her if Obama pardons her?
Be funny to see Chelsea.s wallet and all it has is a old lottery ticket and an EBT card in it
An article of impeachment is not an indictment.
Nixon pardon was never challenged. Take it to court or just use executive order to nullify.
Gerald Ford did it to Nixon.
How ironic.
Doesn’t she have to be convicted of something first to be pardoned?
Obama is going to have a pretty big stack of pardons to sign.
some how to many people’s thinking, doing wrong, does not necessarily make one “guilty”. The Clinton’s are not “bad” people and everyone knows only “bad” people can be guilty. LOL
The leading Supreme Court case is Ex parte Garland (1867). Justice Stephen J. Field, writing for the Court in a 5-4 decision, held that the President’s pardoning power is ‘’unlimited,’’ and ‘’It extends to every offense known to the law, and may be exercised at any time after its commission, either before legal proceedings are taken, or during their pendency, or after conviction and judgment.’’
Well this would do 2 things.
1) Eliminate her ever running again.
2) Take Trump off the hook and preclude prosecution.
Note that pardons are not blanket, and I think they have to be for a conviction — so the FBI would need to finish investigation, bring charges, indict, convict — and then have her pardoned.
He'll use the autopen just like he did to sign laws when he wasn't even in the country.
Oh and it WAS challenged
“In Murphy v. Ford (1975), a Federal District Court in Michigan rejected a suit for a declaratory judgment that President Ford’s unconditional pardon of Richard M. Nixon was unconstitutional. The court found that the President had the constitutional power to grant a pre-indictment pardon, citing Ex parte Garland in its support. “
Can the president pardon someone who has not been convicted of anything?
Preemptive or anticipatory pardons are used on occasion, usually with the belief they are serving a national interest. Such a pardon was issued to President Richard Nixon by President Gerald Ford. The pardon covered all the offenses Nixon “committed or may have committed or taken part in during the period from January 20, 1969 through August 9, 1974.” Another preemptive pardon was issued a few years later by President Jimmy Carter, absolving any person during the Vietnam era that “violated the Military Selective Service Act by draft-evasion acts.”
He wouldnt be,prosecuting her for being a political opponent, but for the illegal things she has done when working in govt.
