SACRAMENTO, Calif. -- A single mother of six in Northern California is facing potential jail time after selling a bowl of homemade ceviche over social media.
Mariza Reulas was cited by San Joaquin County officials for selling her homemade ceviche, a dish typically made from raw fish which has been cured in citrus juices.
Reulas sold the ceviche through a Facebook group called 209 Food Spot, which she joined a few years ago. She says the group was used for sharing recipes, organizing potlucks and occasionally selling food.
"Somebody would be like, 'Oh I don't have anything to trade you, but I would love to buy a plate,'" Reulas said to KTXL.
Last year, the mother was contacted by someone asking to buy a plate of her ceviche.
According to court documents, that person was an undercover investigator on a sting operation from San Joaquin County. Facebook group 209 Food Spot was under investigation because the majority of the group's members didn't have permits to sell their food.
Reulas and about a dozen other people from the group were cited with two misdemeanors: one for operating a food facility and the other for engaging in business, both without permits.
Of the people charged, Reulas was the only one to refuse a plea deal for three years of probation. Her case is headed to trial, and she could potentially end up in jail.
"It was just, like unreal, that they were saying you could face up to a year in jail," she said.
The deputy district attorney for San Joaquin County, Kelly McDaniel, says selling any food not subject to health department inspection puts the people who eat that food in danger. She says it also undercuts business owners who get permits to make their food.
The 209 Food Spot Facebook group was sent a warning before charges were issued, according to McDaniel.

The big problem here is that everyone at the craft sale didn’t run the inspectors out on a rail....

Oh common sense where have you gone. By all means label everything with where it came from (duly denoting whether officially approved or not) but cut out the bans.

In Mexico, anyone can take a pal out to the side walk and sell food to the public. Many of those people have Tb. There are no rules to protect the buy from buying food contaminated in the seller’s home. In Mexico, the vendor takes the bowl you just used and swishes it around in water used for everything that day.
No one checks too see if you are buying fresh, clean meat. I could go on and on. In Mexico these sellers put bricks and mortar businesses out of business. It’s a terrible situation.

In Mexico? Well thank goodness we have an all knowing government to keep watch over us. Yes siree. Because of safety and health inspections there are never any accidents or tainted foods sold from government inspected facilities.
You are welcome to their tuberculosis. To their plates used over and over swished in dirty water.
You have not seen the dame it does to established businesses. They set up 100s of folding tables on the streets and over run the area.
They have begun this in Los Angeles. Luckily the Dept of Health and the Police shut them down here.
She was a fool for not taking the plea bargain. she can trade or give the stuff away but once she goes in business, she is subject to the law.

But I AM quite sure that if she said the phrase "Ejusdem Generis" to the Court, the judge would blanche and the prosecutor would withdraw the complaint in ten seconds flat.
And then the court records would be sealed.
All they’d need would be inspect-and-label programs, and the people who wanted the at least ostensibly safer items would get them. In principle. In practice the la mordida rules, alas. How do you enforce any kind of program if there is no integrity?
And what about the opportunity responsibility of the public to choose? Let um feed each other if they’re used to that set of germs. I wouldn’t touch it with a ten foot pole. Everybody should be satisfied.

If I met you someday, I could tell you of the damages the fold-out table crowd in Mexico have done. Several years ago I went to Mexico City hoping to go to a famed over-100 year old Mexico City restaurant called Las Casuelas.
When we got there the restaurant was closed. The people selling food in carts from fold out tables had put them out of business.
I would say “harrumph” but here in LA, filled with Mexicans, they do this to established Taquerias. The people who pull up with a cooler and a half dozen bowls crowd around, you can barely walk. Of course, the business paying rent, insurance, etc, etc. cannot compete and go under.
Thank god the LAPD tries to take them down ASAP.
Good golly Miss Molly. I thin you forget the site you are at. The gist of this is less government, more freedom. When you invite government into every aspect of your life, you are no longer free. When they control every aspect of the means of production, by definition, it is socialism.
There is NO guarantee that if it is inspected, there is no tuberculin food. The tort system guarantees harsh treatment for those who harm others. There is no legal, or constitutional provision for government to be so invasive into out lives.
The “sting” that the police conducted is a gross misappropriation of money and manpower. Given all that is going on in that area of the state, this is how the spend their time?
No. I don’t buy food off the street. I don’t trust the roach coach, or the taco truck, even if they are inspected but I certainly do not trust our government.
