“Let me 1st say I am not a lawyer....just simeone who has to write warrants and search stiff on occasion.
The NYPD could search for the email evidence without ammending their warrant since they have lawfully obtained the evidence while legally searching for evdince of another crime...aka plain view.
It gets a little hairy when thh NYPD hands it over to another agency who then searches as part of a seperate and distinct investigation of another completely different crime.
Always better to get a new warrant in these circumstances. Dont let the case get spoiled because your too lazy to take the NYPD warrant, cut and paste it along with that detectives statement into a 5 paragraph warrant you wrote to get your evidence....it takes more time to drive to the courthouse than it does to wrote that warrant.
And it never hurts for the same guy serving a search warrant to ammend the warrant and seize evidence of a new crime..even though plain view holds up in court 99.9999999% of thr time...but that doesnt really apply in this case...its just a general best practice.”
Every time the NYPD comes up, I’m reminded of Giuliani, only 3 days ago, promising a BIG surprise was on the way.
I liked the “simeone” part that’s real clever in writing warrants....... lol
With that kind of luck any old thing might come up.
