Donald Trump promised to sue every single woman who accused him of sexual misconduct after the election is over, and blamed the media for using the allegations to attack his campaign.

Trump has threatened a couple of other lawsuits during the campaign, but has never filed them.
I think ignorance is gambling when you can win almost nothing and lose a lot.
Smart gamblers bet when the reward is greater than the risk.
As for calling me ignorant, I wish there was a way the two of us could make a wager on this.
I say Trump never ends up in court on this stuff. You say he will.
I guess we will have to wait to see who the ignorant one is.

Remember that he also said he was going to sue Cruz during the campaign. I don’t believe that has happened, yet.

Not sure if you’re serious, but that’s malice for murder, not defamation, even though premeditated would show intent, intent being all that is required for malice in defamation.
That's an easy one to answer, but first, do you know what the purpose of his lawsuit is? I'd guess due to your question the answer is "no".
What he'll gain is to put the fear of God into people doing such things ever again, not just to him, but to other Republican candidates hoping for higher office. Sleazy tactics like this have kept good people from considering it.

He can sue anyone he wants. The suits might be dismissed but it will still cost money.
And I don’t think he’d have a hard time proving malice aforethought.
Trump is determined to end the corruption in our election system, and these types of attacks have worked for decades, almost always against Republicans.
Exposing the DNC to the voters and making them pay a huge price will be his primary goal in my estimation

Yes, but technically, if it’s a frivolous suit, he could be in trouble, but I don’t think that is what this is.
Not in this case. This is tort law, which like criminal law, is state law and derives from common law which has been hammered out over centuries by judges in the 1600’s through the 1800’s who were very concerned and even prayed about their decisions as being reflective of natural law. Generally, common law is pretty good and sensible.
The federal government and their laws, most of which are unconstitutional and, therefore, invalid, are another story.
The lawsuit is not without merit in any respect. Whether he is a public figure or not.
The privilege claimed by the authors of false statements against a public figure are found in the First Amendment. As such, the privilege is an “affirmative defense” to the defamation and must be both pled and proved by the defendant. The plaintiff need not self identify himself as a public figure or determine before the filing the absence of actual malice.
Accordingly, the suit is valid in every respect. Like all suits, there is a chance it will not be successful.
Trump, who is clearly a public figure, must prove by clear and convincing evidence that
1) the statements were false and
2) the falsity was intentional or negligent (malice)
My point in the post you responded to was that even though I think Trump probably has a good case, his goal should be to right a wrong, not to destroy someone, as another poster alluded to. But I don’t think he’s the kind of guy to try to destroy someone. That is Clinton territory.
Your problem is that you don’t understand the law.
An affirmative defense is the responsibility of the defendant. The plaintiff has no role in it.
All the time affirmative defenses exist but are not pled for various reasons.
You can hold Trump to a different standard than all other litigants if you want to, but it is not the law and he has as many rights as the defendants.
And, how is it you know that these liars have not made their statements with actual malice which precludes their First Amendment defense?

I won’t get into the issues of proving malice, etc.....others here have covered that much better than I could.
I will observe that it seems possible this could be a shot across the bow at not only these current accusers but others that might be lined up to come forward in the drip, drip, drip attacks over the next two weeks. Sort of a “think long and hard” message from Trump to the women and to Allred too.
I will also observe that no matter what they had to pick up on, if it wasn’t this or something else, the driveby media would find something else to headline instead of this policy plan. Trump can continue to hammer this policy at speeches and rallies....and at this point, he should let today’s threat of lawsuits be the end of it.

If Trump’s attorneys can prove that the DNC had the women lie, he will definitely sue.
I doubt they will be able to prove the connection, though.
