New York Times VP and Assistant General Counsel David McCraw sent the below letter to Donald Trump’s legal team in response to a retraction request about The Times’s article Two Women Say Donald Trump Touched Them Inappropriately

Do they have ANY idea of who they are messing with??? This could be the undoing of ALL media...Trump will not let go...he is a ‘viper’ and his bite is deadly...ask the 16 candidates that ran against him, ask the Clinton campaign, they have NEVER been this ‘bashed’ before, and he hasn’t even started...
I remember when I was on the East Coast, he would fight City Hall and he would win, and he didn’t quit until he did...
This Man is amazing, his life, how he raised his family, his business, the people that REALLY know this Man have nothing but good to say about him, he was never called RACIST or had any shame brought towards him until the Clinton Filth showed up, and you can tell what they are going to throw at him by watching and listening to what filth surrounds them and what comes out of their mouth...

Then give front page coverage to Bill Clinton’s accusers. Hillary’s email leaks, the pay for play as SOS, and a host of other topics regarding Hillary’s crimes.
Anyone who thinks Trump will roll over is not listening either.
Sorry these accusations do not qualify as political speech, and thus are not examples of protected free speech. They are claims being made that have not even been vetted to see if they are true. Nor have the looked into the who the women are that are making the claims. For it to be truly political speech, it would have to come from one of his opponents personally.
This is political assassination and slander.
In the law, if it's not true, and they didn't take ordinary measures to check it out--and they're in the business, and are held to some minimal standards--they can be sued for "reckless disregard of the facts."
If the only source is the Clinton campaign, of course, that makes the presumption of reckless disregard even stronger, and then a good lawyer would look for whether the paper actually knew the story was false.
I thought their response looked incredibly weak. The words they didn't say were: We checked this out, and it's true. Just saying, "We couldn't damage his good name because he doesn't have one" is contradictory. They wouldn't have published it if it didn't represent something about his character that wasn't known. The fact that there's open evidence that they've colluded with the Clinton campaign makes the presumption stronger than they're trying to damage Trump.
If that's so, and they know, or ought to know, that the thing's not true, that's libel. Motive + falsehood + potential or realized damage = $.
THIS is exactly why Trump won’t back down to the Times, Clintons or anyone else:
Not just “absent malice” BUT NO EFFORT AT DUE DILIGENCE. Trump is gonna OWN the NY Times.
God, please reign your wrath down upon these liars and evildoers, and please may it be soon.
I hope, when all is said and done, the paper will be known as Trump Times. :)

Newt (on Outnumbered today)would agree and I sure hope Trump is listening to him. It’s the best advice he can get - stop responding to all the garbage and get to the issues and stick to them.
He is, have you seen an election like this one before? Have you ever seen how corrupt our government and the people that we have elected to represent us as corrupted as this time?
God has his hand on Trump and those around him, God has turned the arrows thrown at Trump back to the people that have flung them...have Faith, my friend, Trump is going to the White House!!!

Failed to mention that the charges came out just before the election.
In American law, a person’s media-construed and generated reputation is not admissible in a court of law.
If you are a Democrat, especially a liberal Democrat, apparently so......at least until the real hostilities start.
