The letter is just necessary foreplay to the lawsuit. NYT will not win this suit on "no harm to his reputation" basis. That is a decision for the jury, not for the defendant.

Likewise on diligent work by the reporters. NYT is simply describing it's defense in court, and any paper is going to assert what NYT did.

Think about it, NYT says "no harm to his reputation" when what, half a dozen senators and Reps, in his own party, publicy denounced and abandon him as a result of seeing the false report, and NYT says, "no harm"? It's risible! Doesn't pass the straight face test.

It goes to trial. Let the jury decide if NYT was reckless or not.
