If anybody dies simply execute the driver for murder and be done with him.

If true that they were threatening the driver and passenger, I have no problem with him plowing through the attackers. You apparently do.
If a bunch of people surround my car and start beating on it I’m leaving. You would be well advised to get out of the way.
