Gun looks like an old Colt 9mm.
With that guy’s rap sheet of aggravated assault with a deadly weapon and previously firing at officers I have to give the cops the benefit of the doubt on this one.

He has an obvious exposed ankle holster. Possible, but I wouldn't be so sure right now. The image is not that clear. In addition, I would use caution because if he were wearing an ankle holster the Chief would have very likely broadcasted that to the world.
