The juvenile justice system in Colorado does not consider an "infant" (any child under 10) as being capable of committing any kind of crime; no understanding of intent or formulation. At the time of the murder Burke was nine. Family Court could have ordered psychological supervision, but he could not have been charged with a crime.

You can “charge” anyone, they just can’t be “tried” in criminal or juvenile court.

In addition he could be charged now for conspiracy as that aspect of the crime has been ongoing.
