I could be wrong, but I believe you can use up to 30 seconds of any song without requiring permission or payment of royalties.

How about the guy who created the Les Deplorables image and posted it on Reddit? He got banned. What’s up with that?

My good guess is Trump knows he won’t get sued for using the music. He’s used other persons’ music much to their chagrin without legal damage.

If he has a musical composition license from a performing rights organization (PRO) such as ASCAP, BMI, and SESAC, they can complain all they want and he can still use it. The license can be obtained by either the campaign or the venue (e.g., hotel, restaurant, stadium). Venues usually pay periodic licenses to cover any performances of all the songs in a PRO’s catalog. So, if the campaign didn't have a license, but the venue had a license - and this song was in their catalog - he is free to use it.

Yeah. Wasn’t it bon jovi or someone who told GWB that he could not use his songs in his rallies? Someone like that I think.

This issue has already come up. Trump has paid the licensing fee to use any music he wants at his events. I'm pretty sure the rights holders are forbidden by a turn of the century antitrust law from discriminating against anyone. You pay the fees, you play the music. No choice in the matter.

That's also why Rush Limbaugh is able to use bumper music from so many liberals who wish he'd stop.
