This item popped up the other day at The Volokh Conspiracy and its a rather sad sign of the times. .....
On January 8, 2014, Complainant filed a formal complaint in which he alleged that the Agency subjected him to discrimination on the basis of race (African American) and in reprisal for prior EEO activity when, starting in the fall of 2013, a coworker (C1) repeatedly wore a cap to work with an insignia of the Gadsden Flag, which depicts a coiled rattlesnake and the phrase Dont Tread on Me.
Complainant stated that he found the cap to be racially offensive to African Americans because the flag was designed by Christopher Gadsden, a slave trader & owner of slaves. Complainant also alleged that he complained about the cap to management; however, although management assured him C1 would be told not to wear the cap, C1 continued to come to work wearing the offensive cap......
...As Volokh points out, there is no indication that the accused worker ever did or said anything to the complainant which could be construed as racially insensitive. He simply wore a cap with the Dont Tread on Me flag on it. For the EEOC to even take up the case provides a signal that we have entered an era where nothing actually has to be racist to get you in trouble. All it takes is for someone else to decide that it looks racist to them. This is apparently sufficient to complete the offense in the eyes of the government. Because Gadsden (the flags originator) lived in a time when slave ownership was still legal and broadly practiced, that makes the flag a racist symbol centuries later. Ian Tuttle at National Review notes the flaw in this logic.

But the gay flag is perfectly ok.
Show the dismembered snake, and use the motto: ex uno plures
(Divide and conquer the disparate splinter groups of disaffected hate mongers which comprise the Dem coalition.)
“African Americans” are a bunch of whining crybabies. Although I wear the First Navy Jack “Don’t Tread On Me” flag on my hat, I dare some bastard to try to punish me for wearing it or dare them to try to force me to remove it. I’m still an American and haven’t fallen into one of the various tribes yet. I plan on continuing to remain an American.
Once, this was "The Land of the Free". Sadly, not anymore.
Not only was it our first Navy Jack, it is our present Navy Jack...has been since 9/11/02. Of course it would not surprise me in the least if TPTB were to order a return to the 50 star Jack.
The complainer is a snake? Likes to walk all over people?
I have worn one of those for years. I got it at Quincy market in Boston.
No one has ever mentioned. I think people are really over sensitive.
I guess we shouldn’t read the bible because there are slaves in it.
In passing, I saw that wearing the Navy Jack was questioned, but affirmed. So we can check one off for the good guys.
Right wing groups should start carrying NAACP flags. By the logic of the ‘oh so silly’ that would make the “NAACP” a racist term... We’re dealing with idiots here... this could be fun.
And we should also rename all the states because they once condoned owning slaves.
“And we should also rename all the states because they once condoned owning slaves.”
By their “logic”, we should ban blacks because they started slavery in the colonies and they owned slaves.
In 1655, Anthony Johnson, a black man, sued in Virginia to enslave John Casor, a black man, thereby setting up the slave trade.
“I dare some bastard to try to punish me for wearing it or dare them to try to force me to remove it.”
Barbara Fritchie would agree.
By this logic, I guess one dollar bills and quarters are racist because George Washington owned slaves.
Thanks FRiend. You sent me to Wikipedia. I consider every day that I don’t learn something new as being a total failure. Today, I learned something new. I love AMERICAN history.
The Jack (extended snake) is OK......for now
The headline, "Don't Tread on Me" flag is wrong.

The Declaration of Independence was written by an "owner of slaves." Is the American founding offensive to African Americans too?
