The police shooting of an African-American caregiver, who was lying in the street trying to help an autism patient, was accidental, according to the local police union representing the North Miami officer.
The officer had intended to shoot the patient, whom he thought posed a danger, but accidentally shot the caregiver instead, said John Rivera, the President of the Dade County Police Benevolent Association.

AGain, in case you missed it, I SAID that I wasn’t addressing this particular issue. A person sitting CAN present a threat, just as a person lying on the ground can still be a threat. Rodney King presented a threat as long as he resisted and refused to comply with lawful policy orders, whether on the ground or not.
The shoot in question certainly sounds like a gross error by this cop. But “unarmed” doesn’t mean anything, generally.
I’m not comparing the two in the least, just addressing the “unarmed” qualifier.

What makes you think you know all of the facts of this incident? A 5-second video snippet put out by cop-hating, BLM-loving, fact-averse CNN?
Cops have to use their sense of perception to evaluate a situation. The patient wasn’t threatening them. This is not due an apology. It deserves full restitution and discipline, not a criminal charge.
It’s the Split Second Guess Syndrome. But why, if the shot missed and it was really necessary to shoot the probably harmless man with the toy truck, wasn’t there an attempt at a second shot.
This does not look like even the most dubious of the BLM incidents.

Gee, really makes folks want to call the cops in event of a home invasion robbery. But one would hope at least, that after the cop shoots all the family members (and their dog...don’t forget to shoot the dog), the cop might also find time to shoot the bad guys too.

So they are excusing the cop by saying that well, he had to shoot someone and it is too bad that he shot the therapist instead of the student. That sounds like a Margie Sanger rationalization.
Some questions to ask:
- How were the police made aware of the call? What did the caller who reported it say?
- How long were the police in contact with the subjects?
- What transpired before the short video clip?
- Were the subjects known to the police? Did they have a history of violence or crimes?
- Was the area of town a high-crime district? If so, what types of crime?
- Could the police tell what the autistic person was holding? How would the police know that he is autistic? Were they told?
I doubt you can answer any of these?
Police go into most situations complete blind, and have to listen to armchair quarterbacks pontificate about the facts police should have acted upon after they are known later.

911 call. Police were told someone was suicidal and had a gun.
How long were the police in contact with the subjects?
The cell phone video is several minutes long so probably for a period before the start of the video and for some time afterward when the shooting occurred. How much time would they need?
Were the subjects known to the police? Did they have a history of violence or crimes?
No. And no.
Was the area of town a high-crime district? If so, what types of crime?
Don't know but what difference does it make? The police were not responding to a report of a kidnapping or shooting or violent crime.
Could the police tell what the autistic person was holding? How would the police know that he is autistic? Were they told?
Listen to the video. They were told by the unarmed man that they shot.
This is North Miami were talking about.
They really shouldn’t be allowed to have their own department, used to be part of Dade County.
Doing a terrible job, maybe they can get George Zimmerman in there to head up training
If he did not have a Magic Blue Costume on at the time he would be charged with:
1.Assault with a Deadly Weapon
2.Attempted Murder
3.Attempted Manslaughter
4.Using a Firearm during the Commission of a Violent Felony
5.Kidnapping, With Special Circumstances of using a Firearm during a Kidnapping.
This is a Bare Minimum List that EVERY OTHER CITIZEN WOULD BE CHARGED WITH!
Sounds like LIFE WITHOUT PAROLE
I think just put the former officer in General Population for a few years.
