MA AG Maura Healey Takes Aim at Copycat Assault Rifles (makes up her own gun rules again)

The state’s top prosecutor on Wednesday announced she has sent a directive to gun makers to no longer sell weapons in Massachusetts that are similar enough to assault rifles to kill like assault rifles, but not similar enough to trigger the statewide ban—or so they thought.

Massachusetts bans high-powered guns like the ones used in recent mass shootings, an effort to extend at the local level a federal ban that expired in 2004. Gun companies, though, are crafty, and they’ve been selling sort-of-but-not-quite assault rifles that also have immense capacity for shooting things, Healey writes in a Boston Globe op-ed published today. She also announced the crackdown at a news conference in her office this morning. She writes:

The Massachusetts assault weapons ban mirrors the federal ban Congress allowed to expire in 2004. It prohibits the sale of specific weapons like the Colt AR-15 and AK-47 and explicitly bans “copies or duplicates” of those weapons. But gun manufacturers have taken it upon themselves to define what a “copy” or “duplicate” weapon is.

They market “state compliant” copycat versions of their assault weapons to Massachusetts buyers. They sell guns without a flash suppressor or folding or telescoping stock, for example, small tweaks that do nothing to limit the lethalness of the weapon.

Gun makers need to invoke the Hillary Defense, ie, they had no intention to violate the law as evidenced by their attempt to comply with the law.

This is what happens when uninformed people attempt to write laws on a subject they know nothing about.

Makes you wonder about the rest of the laws they pass, doesn't it? On second though, no I don't wonder at all.

This is ridiculous. AG Maura Healey has designated herself Queen of Massachusetts.

What she proposes will fail in the first case taken to court. What she proposes is NOT in the current law. Her selective enforcement pledge has no teeth.

She lies when she says that the gun manufacturers have decided what is compliant and what is not. The LAW clearly spells out what is compliant and what is not.

Even still, I know of two gun dealers here in MA who have decided not to push it and are telling customers that after today, no sales of Ruger 556s or S&W Sport 5.56 rifles will be made. I wonder if this "directive" (i.e. nastily worded letter) has gone out to S&W and Ruger.

The whole thing is BS and will not stand.

The AR-15 is already one of the least "lethal" rifles manufactured. I don't know what else any manufacturer could do to make it less "lethal". It certainly is not a "high-powered" rifle.

As evidenced by your local dealer, there doesn’t have to be enforcement to result in compliance. Few are eager to risk not only their business but all of their net worth on a gamble that the state won’t come knocking and seize inventory as evidence.

What choice do they have when the legislature specifically refuses to define the terms in the statute?

When the 1994 AWB expired in 2004 I was making damned good money. A lot. I also knew right down to my bones there were soul stealing bitches like this AG out there or coming up. I took advantage of the expiration. Very Good advantage, in fact.

I love this. First they come up with an entirely made-up category, Assault "Weapon", then they try to define it, then when the definitions prove inadequate, they remove them and replace them with a vague "A is similar to B and we banned B" cop-out. If those definitions never did refer to the actual lethality of the gun, maybe it's because they were nonsense to begin with?

Now we have locutions such as "same operating system". What does that mean, that all direct-impingement gas systems are Assault Weapons? That gas piston systems are? Do those affect the lethality of the weapon any more than the laughable bayonet lug did?

Doubling down on stupidity is a liberal trademark, and this is quadrupling down.

The left loses the gun control debate every time some registered democrat uses a gun to kill a bunch of innocent people. Just take a look at the stats on new gun sales and gun manufacturers' equity stocks and weep.

They need to drop the issue and take up something more attainable, like forcing rent-a-potty mobile toilet dealers to offering a line of unisex extra tall porta-potties to accommodate the needs of transsexual giraffes.

My condolences to any Mass residents for the abuse of your Second Amendment rights. Remember, you can always move.
