Agree. Based on his other comments he always stipulated there needed to be a referral before anything gets done by FBI.
I do not recall any referral being made, and certainly no one asked that direct question.
I think Chaffitz was fishing with his question to see what Comey would say, or at the most positive spin. He knows there is one but just wanted to get something on the record about that possibility.

I was half listening, but I thought I heard someone question Comey about whether non-compliance with FOIA was tied in with the investigation and he either said no or declined to answer. Anyone clarify that because it is pertinent if there might be ongoing investigations which many suspect?
