To be clear this is not to suggest that in similar circumstances a person who engaged in this activity would face no consequences. To the contrary those individuals are often subject to security or administrative sanctions but thats not what were deciding here.

If you think of 793(f) as a parallel to murder 2, Comey may be right, the facts don't add up to that.
But that doesn't mean the facts don't add up to the classified material equivalent of "manslaughter," 18 USC 1924(a). The case in that thread is a 1924(a) case, I've linked to the indictment a few times. But today, all Comey talked about was the elements of 793(f), an offense of substantially different character.
A lot of Freepers consider Elliot a RINO, but he definitely had the courage to "walk the walk." He also landed with the first wave of the Fourth Infantry Division on Utah Beach on June 6, 1944. Would Comey put his life on the line for ANYTHING?

This said, it is entirely possible that James Comey saw many aspects in today's announcement, that you are overlooking. It not just possible, but probably, that he has locked Mrs. Clinton & the Administration into a distinct disadvantage for this fall.

Comey's exposition makes clear that his review of precedent was limited to 793(f) cases.
All the cases prosecuted involved some combination of: clearly intentional and willful mishandling of classified information; or vast quantities of materials exposed in such a way as to support an inference of intentional misconduct; or indications of disloyalty to the United States; or efforts to obstruct justice.
That is probably true for 793(f) cases, just like murder 2 requires an intention to kill somebody.
But as the Nishimura case shows, there are other statutes.
I point this detail out so that people recognize the arguments about "intent" (part of the court lore of 793(f)) as avoiding the crime that certainly was committed.
