WASHINGTON The Supreme Court on Thursday rejected a challenge to a race-conscious admissions program at the University of Texas at Austin, handing supporters of affirmative action a major victory.
The vote was 4-3. Only seven justices participated in the decision, as Justice Elena Kagan had recused herself for prior work on the case as United States solicitor general and the late Justice Antonin Scalias seat remains vacant.
Justice Anthony M. Kennedy wrote the majority opinion, joined by Justices Ruth Bader Ginsburg, Stephen G. Breyer and Sonia Sotomayor. Chief Justice John G. Roberts Jr. and Justices Clarence Thomas and Samuel A. Alito Jr, dissented.

It now will be impossible for any person of color to claim they were admitted to the University of Texas based on merit. They will always be suspect in the eyes of business and the general public. People of color who did get in based on merit should file suit now that they have been demeaned.
Most people don’t know it, but athletes are allowed to take remedial courses at community colleges that will count toward their NCAA eligibility. One reason many athletes leave after their sophomore year is that they have run out of remedial coursework and they can’t hack regular coursework, even though they are given a tremendous amount of help.
“But we dont pay taxes to Caesar to get Caesars nephews in.”
If a person is a liberal (or progressive, or leftist, or whatever euphemism is current) and is in a position to hire, what are the odds that he is going to hire people who disagree with him on every element of his world view?
As Alexander Solzhenitsin wrote, “Evil people always support each other; that is their main strength.”
No Obama voter is going to hire anyone who is not as evil as she is herself. This isn’t JFK/RFK nepotism, but it is tribal nepotism.
We must clean out (or, better, abolish) our bureaucracies from top to bottom, and those fired must never be rehired in any job that pays more than minimum wage.

One of my work-study jobs back in the 1970s was helping a college basketball player who had realized he was not going to the NBA. He was a senior, and could not read his textbooks.
Ha, how do we implement that under the constitution. It would be a violation of freedom to do private business.
Diversity is important? I don’t remember reading that in the Constitution. So state based racism is sometimes just okay? We are so screwed if this is what amounts to careful decisions.
Nothing like supporting institutional racism against all non-African races to set the wrongs right. Such is the ghost that was once higher and enlightened education.
But didn't recuse herself on the gay marriage vote..
Here is the unintended legacy I see.
If disparate treatment based on race is constitutional in service of the compelling governmental interest of diversity in education, then disparate treatment based on religion is constitutional in the interest of national security. And disparate treatment based on national origin is constitutional to protect national borders.
Donald Trump says Thank You.
Makes more sense than the constitutional garbage announced today.
Even more damaging, it reinforces an official government policy that in fact blacks and Hispanics ARE inferior. The same government that insists we treat them as equals simultaneously insists they are not.
The worst part comes afterwards, where the recipients of fake educations slam into the wall of reality in the workforce (if they can even find work). They initially don’t want to accept that they’ve been handed worthless paper in unearned degrees (even high school diplomas), and when reality eventually sinks in they are even more combative and resentful. Tokens are a nasty, angry bunch - an absolute horror for co-workers and supervisors.
An African co-worker (not American) was boasting of a masters degree; he has a good work ethic but is functionally illiterate (never mind cursive; he can’t PRINT). I was puzzled as to how he came by this, then learned that the state school that issued it had lost its accreditation and was recently in the news because a blacktivist had sent a fake tweet threatening blacks (she was just sentenced to six months in prison a couple of days ago, and has to pay thousands for the police response). These “colleges” are just places for tokens to “play school” for a few years before going out to “play work”.
Unfortunately for this African fellow, he doesn’t realize yet that his degree (for which he must have paid something) is worthless; anyone spending two minutes with him will realize he is a well-meaning semi-literate that can never produce a legible email, never mind a meaningful report.
Isn’t “Affirmative Action” simply a law that can be removed?
BBC WORLD NEWS JUST CALLED IT FOR BREXIT
Yeah but since when has “making sense” applied to the SC?
One can always tell what the Robotic 4 are going to do. NONE of them has one clue about the Constitution. And giving all the power to “Swing Vote” Legacy Kennedy is far too much concentration in one guy, esp one out to secure favortism
Just another reason to vote against Hillary. She will appoint more non thinking, affirmative action type “judges”. and then more hell will break loose
In an ideal world, yes. Unfortunately, courts are forcing it on businesses by threatening lawsuits for having “preferred minorities” underrepresented at all levels.
Just as women opting for childrearing/caring for parents/other options hasn’t prevented lawsuits citing “gender discrimination”, now American companies have to worry about illiterate minorities with PhDs on their payrolls - and defend why they pay them $10 per hour to file - they have PhDs!!!
“how do we implement that under the constitution. It would be a violation of freedom to do private business.”
Sorry, I’m not following. Are we talking about cleaning out bureaucracies?
Penalize the people dismissed by forbidding them to earn more than minimum wage afterwards in private business?
Are we talking any measure to clean out bureaucracies including vindictiveness?
Also, even if it is only about re-employment in civil service, we are to blame if the rules are so lax that bureaus can become ‘cratic anyhow.
“Penalize the people dismissed by forbidding them to earn more than minimum wage afterwards in private business?”
I was presuming that most people would think hanging, drawing, and quartering to be excessive.
“Are we talking any measure to clean out bureaucracies including vindictiveness?”
Are you saying they don’t deserve punishment for their treachery?
“Also, even if it is only about re-employment in civil service, we are to blame if the rules are so lax that bureaus can become cratic anyhow.”
No. Satan is smarter than we are, and he never sleeps. The only one on this earth he could never get over on was Our Lord. It took his minions a long time (by our standards) to weasel their way to the top of our bureaucracies, especially back when good men actually opposed them.
Our bureaucracies are just another battleground in the ancient battle of good versus evil, and it’s not our fault that evil showed up.
