The only way they’re not mutually exclusive is if you believe the justice system has and always will have a perfect record in such cases. Otherwise one must acknowledge that having the death penalty means putting some innocents to death along with the guilty.

Nope. The difference is "due process." Accidental execution of the innocent has it, and abortion doesn't.
