House and Senate Democrats told Republican leaders Thursday to postpone a Memorial Day recess until their demands for Supreme Court nomination hearings and emergency spending to combat the Zika virus and other crises are met.
From the opioids and heroin crisis to the lead-tainted water scandal in Flint, Mich., Congress faces a larger workload than ever but has opted to work less in a contentious election year, according to House Minority Leader Nancy Pelosi and Senate Minority Leader Harry Reid.
Congress is set to skip town Thursday for its Memorial Day break and will not return until the second week of June.

Is the Senate truly going to be on recess?? I ask because if they are then Obama will do a recess appointment of Garland to the Supreme Court. So I question if this is a real recess coming up.
What “recess appointments” can Obama make?
I can’t tell you how many lazy a$$ flight attendants I have flown with who think I am going to forget how shiftless and sorry they were because they finally lifted a finger after 4 days and picked up a trash bag and walked through the cabin trying to act like they had worked the whole trip.
Pelosi, Reid, take note. You can’t try to make us forget all the destruction you are responsible for by trying to act like you actually care about us now.
Under Noel Canning v. NLRB, if the Senate is in recess for less than “10 days” the President presumptively does not have the power of recess appointments. Less than ten days requires an emergency not forseen prior to the recess.
Wait...a...minute.
If the Senate is in recess doesn’t that open the door for Obama to make a Supreme Court appointment?

See comment 11 above. Plus, the Supreme Court gives great deference to the Senate to define what “recess” is, since it is not defined in the Constitution itself. Any pro forma action by the Senate is not a “recess” day. Also, Noel Canning chided the Administration for deliberately seeking to avoid the confirmation process, which the Court says it cannot do.
Noel Canning v. NLRB was a 9-0 decision by the SCOTUS. Even Kagan and Sotomayor voted against the regime that appointed them, so it’s pretty solid law.
The sooner those two cretins reach room temp, the better for the multiverse.

However, if Nancy and Harry are calling it a recess is that some sort of evidence that this is a recess under the Senate’s own definition?
And if the Senate refuses to hold hearings might not the court be more inclined to rule that Obama didn’t deliberately seek to avoid the confirmation process?
