Was just reading a portion of the dissenting opinion of the judge on the Second Circuit and I was struck by his lack of exoneration of Brady. He seemed to concentrate solely on the severity of the penalty and how it was unevenly administered.
Again this is a brief review of the published dissent, if I am wrong point me to the full dissent.
From an adjudication stance whether or not Brady did it is completely immaterial. In the end this is a contract dispute, and the CBA gives Goodell broad authority to levy punishment as he sees fit for conduct detrimental. The dissent basically says there should be reasonable limits to “as he sees fit”.
