A Federal Circuit court ruled today that a local Virginia school board violated the law by not allowing a girl to duse the boys restroom.
If the convoluted decision survives, according to the judge who opposed the two-to-one decision, schools could never meaningfully provide separate restrooms and locker rooms on the basis of sex [and] privacy concerns would be left unaddressed. The decision is illogical and unworkable, Judge Paul Niemeyer said.
In G.G. v. Gloucester Country School Board, the 2-1 court determined that the school board discriminated on the basis of sex in violation of Title IX.
Roughly one in every 330 Americans change their name from one sex to the other sex.
Title IX explicitly bans discrimination based on sex, but the Department of Education told the school district last year that discrimination based on the new idea of gender identity is the same as discrimination based on biological sex.
Specifically, the policy was imposed via an agency letter not a regulation in which officials say, When a school elects to separate or treat students differently on the basis of sex a school generally must treat transgender students consistent with their gender identity.
The entire case hinged completely on this letter from agency officials, even though the notion of gender identity was not known to the congressional drafters of Title IX back in the 1970s.
G.G. is a young girl who announced not long ago that she is a boy and had always felt like a boy. Her parents allowed this to proceed, and the School District allowed her use a private bathroom that was also open to all other students. The girl said this caused her anxiety and she demanded use of the boys restroom.

We are headed to hell in a hand basket....at warp speed!
Then it’s not “boys restroom” any longer. Rename it.
The obvious solution is single-person bathrooms, with provision made for the handicapped and their handlers.
But it’s not about right/wrong/privacy. It’s about forcing us to think according to the approved dogma of the new world of PC.
Hang the judge.
Nah, just label them XX and XY.
The problem is, even if people are restricted to the bathroom that matches either their “plumbing” or their DNA, you’re still going to run the risk of weirdos forcing themselves on your kid. They no longer feel any pressure to restrain themselves, and you’ll be denounced as “homophobic” and all kinds of other liberal slander if you object to their actions. It’s becoming the Turner Diaries out there, only with degenerates instead of being about race (though race seems to be heading in that direction too, unfortunately).
I remember when I was in school and dused the girls' restroom. I got in a lot of trouble that day.
That's been going on longer than OBONGO has been in office. Turn on a TV during the day lately? Littered with "Who's my babby daddy?" shows and been that way for 20+ years now.
The more that crap is on TV, the more that crap becomes normalized, expected, and becomes part of every day accepted "normal" life.
This country is headed down the shitter no matter who sits in the White House in Feb. 2017.
Liberals are evil.
1. School board should refuse.
2. School administrators should refuse.
3. Parents should withdraw their children from the school.
4. Students should beat the ever-loving shyte out of the perv.
5. Problem solved.
Well, I really don’t give a damn what the government says. If I catch someone with a penis in the little girl’s room, he’s going to regret it!
Until she is able to add Y chromosomes she should use the girls. The appendage means nothing.
Label them “XX” and “XY”. Of course that means people would actually have to listen in school.
You left out tarring and feathering the peverted judges
And then there'll be the $20 million lawsuit because,as we know, she will have done all that on the instructions of her parents' lawyer.
Heaven forbid some freak kid feel anxious. Like this method of freeing her of her anxiety won’t cause others to feel anxious.
These federal judges obviously have no clue what Title IX requires.
What?
Has she been practicing, or is she going to stand there and pee all over herself?
BillyBob clearly understands that there's a difference between boys and girls.
When do the schools stand up and tell the Feds to keep their damn blackmail money?
Then, when do the citizens tell the Feds to return those moneys to the people?
By what authority does the federal government now declare up down?
The madder and more unreal it is, the better they like it. Because when they do this, they're showing us who is boss.
