On Tuesday, New Jersey Administrative law Judge Jeff Masin ruled against a lawsuit claiming that Senator Ted Cruz is not eligible to become president because he is not a natural born citizen. The plaintiffs claimed that Cruz is ineligible because, although he is the son of a US citizen, he was born in Canada (where his parents were living at the time). Judge Masins opinion is notable for its detailed analysis of the evidence on the original meaning of the natural born citizen and recent scholarship on the subject. I think the opinion is well-reasoned and very persuasive.
Judge Masin relied considerably on legal scholar Michael Ramseys excellent recent article on this subject. Prof. Ramsey has put up a thoughtful post about the decision at the Originalism Blog (a blog which is also cited in the opinion).
While Judge Masin relies almost entirely on originalist arguments, living constitutionalists have every reason to support his conclusion. Quite simply, there is no good living constitutionalist reason to interpret the natural born citizen requirement in a narrow way that would exclude people who have been American citizens since birth, but happen to have been born abroad. Even nonoriginalist critics of Cruzs eligiblity generally rely on on originalist arguments rather than trying to justify their position based on living constitutionalism. That is likely because there is no plausible reason to conclude that barring this category of citizens from running for the presidency benefits the nation in any way. Some of them are likely to be bad candidates, unfit for office. But the same thing can be said of numerous candidates born within the US...

Those are two VERY different things! Dr. Fukino should stick to medicine and not dabble in constitutional law. I don't care if he was born in the Lincoln bedroom! If Barack Hussein Mohammed Obama, Senior (A British subject from Kenya) is Mr. Obama's father, there is no way he is a natural-born citizen!! Native-born, perhaps, but that's not what the constitution calls for.

What would this Judge’s ruling have been if he knew that at the time of Ted’d birth his mother had given up her American citizenship and become a Canadian citizen? Would that fact (if true) make a difference?
It’s like the elephant in the room that no one is talking about, no one is asking, no one is researching in Canada for the answer...... or are they? You better believe that Hillery has and she knows the answer and if true, then she will hold on to it until the last minute to disqualify Cruz should he be her opponent.
All I am saying is that we had better be darn SURE that Cruz’s mother was not a Canadian citizen at the time of his birth. Are we sure? Just asking?

I had two daughters born overseas in the 60’s while I served in the Navy and the Consul told me that they were not eligible to run for president. They were citizens but not natural born. That bothered me then and still bothers me and is a huge reason why I object to people thinking Cruz is eligible.
What else is wrong is a wetback can cross over the border and drop her load and that kid is eligible to run for the highest office. I really don’t believe that is what the 14th Amendment means but that is what most people believe today. Just not fair.
Things change for political correctness and no one has the balls to stand up for what is right and decent and you fall into that category in light the the fact you know NBC requires two citizen parents.

We should avoid future disputes of this kind by amending the Constitution to get rid of this form of indefensible discrimination against naturalized citizens.Brilliant, right?
