This is all fun stuff and will no doubt lead to some very clever jokes on The Daily Show. But there were also some very serious legal questions at stake. Namely, what limits does the U.S. Constitution place on the legislative power of state governments, and what role do federal judges play in enforcing those limits? Related to that, what sort of unenumerated rights (if any) are protected from state infringement by the 14th Amendment?

One of my previous towns of residence had a law about women wearing red shoes on Saturday afternoon. (ostensibly because: prostitution. Or something)
NO one ever imagined the township would actually WASTE MONEY prosecuting that law.
Not when there were REAL crimes ongoing.
And the argument TX used wasn’t ‘we are a state, it’s our law, we can’. It was ‘because incest’. Which is even dumber than the red shoe law.
I don't think anyone on this Forum doubts his legal acumen. It's the rest of the package that is troubling. It takes more than SME (subject matter expertise) to be a capable leader of so complex a nation in such a dangerous world. He is a tactician; but he is not strong original thinking.
I do too. It will be a perfect excuse to illustrate the idea of federalism. Texas should be allowed to regulate (or not regulate) dildos. Colorado should be allowed to regulate (or not regulate) marijuana. New York should be able to regulate (or not regulate) soft drinks. California should be able to regulate (or not regulate) automobile emissions. North Carolina should be able to regulate (or not regulate) public restroom use, etc.....

Quite aside from the basic rights of privacy and the pursuit of happiness, what about the rights of elderly or handicapped couples. For example if an older man cannot use Viagra because of a heart condition, he can still pleasure his wife with sex aids. Of course, some fundamentalists would say you should only have sex for procreation, and if you can’t procreate, you shouldn’t have sex. That is the logical extension of Cruzian behavior policing.
What about the conservative principal of limited govt - you want Sharia law police?
Ted was Solicitor-General for the state of Texas. Texas passed a law. The law was challenged. The state directed Ted to defend the law in court. Ted did his job as directed.

Conservatives don’t run to the courts whenever they meet a law they don’t like. They get the legislature to repeal it.
Much of the president’s job is to sign legislation, veto legislation, make executive orders and enforce the law. Sounds to me like legal expertise is a useful skill to have.
