Judge: Ted Cruz eligible to be on N.J. primary ballot

Sen. Ted Cruz of Texas meets the criteria to be considered a “natural born citizen” and can run in New Jersey’s Republican presidential primary on June 7, an administrative law judge ruled Tuesday.

Judge Jeff Masin’s decision will now go to Lt. Gov. Kim Guadagno, who also serves as New Jersey’s secretary of state, for consideration. She can choose to accept it in full or in part, or reject it.

Masin heard arguments Monday on two challenges to Cruz’s eligibility to run for president. In both cases, the challengers argued that, because Cruz was born in Canada, he is not a natural born citizen, one of three constitutional requirements for the presidency.

Cruz, 45, was born in Calgary, Alberta. His mother, a U.S. citizen, was born in Delaware. His father was born in Cuba. Cruz has said that a child of a U.S. citizen is automatically granted citizenship at birth and is therefore “natural born.”

Why you didn't just go read it for yourself is curious, but no matter.

If I run across anything that supports the contention that his mother has somehow given up her citizenship, I will make a point to get it to you and others.

Just to be clear, I don't think he's actually eligible. I just don't care anymore if we abide by the requirement.

Once we let Obozo in, the rule doesn't matter anymore.

For example, if the Founders created the "natural born" requirement with the understanding or intention to incorporate the statutory laws of England, then why, in the notes of the committee discussions of the drafting of the Naturalization Act of 1790, did one of the committee members state that "The case of the children of American parents born abroad ought to be provided for, as was done in the case of English parents, in the 12th year of William III." If the English statutes were already incorporated, why was Congress in 1790 drafting a law specifically in order to provide for what was already provided for in one of the supposedly incorporated English statutes?

FWIW the courts will rule that anyone born a citizen would qualify as a NBC.

So? They will also rule that two men can get "married" and that middle aged queers can use little girls' bathrooms.

Court rulings really don't mean much anymore. The courts are nuts nowadays.

In fact arguing about how many angels can dance on the head of a pin is probably more productive and edifying than trying to convince anyone on this forum to change their minds on the NBC issue.

Some minds are subject to reason and facts, and many are not.

To some they would rather see the country destroyed from within than to elect an ineligible leader.

Yeah, i've noticed that sort. I've argued with them too.

Frankly if Maggie Thatcher were alive and on the ballot against this group of clowns, not only would I vote for her, but I’d quit my job to work on her campaign.

At this point, so would I.

We have a country to save. This kind of nonsense is not going to help. We are all engaged in a circular firing squad here. Thankfully I have run out of ammunition.

To me, the issue is academic. I want Cruz to be President. I'll settle for Donald, but my preference is Cruz. As Lincoln pointed out:

By general law life and limb must be protected; yet often a limb must be amputated to save a life; but a life is never wisely given to save a limb. I felt that measures, otherwise unconstitutional, might become lawful, by becoming indispensable to the preservation of the constitution, through the preservation of the nation. Right or wrong, I assumed this ground, and now avow it.

I think we are in just such a situation. The only man I see as most likely to address some of the most serious problems the nation faces, happens to be the one with dubious eligibility qualifications.

But that issue is of small matter compared to the other issues we face.

Perhaps another judge in another state will see things differently. However there were more than 200 attempts to invalidate the candidacy/presidency of Obama including 27 petitions submitted to the Supreme Court. They all failed.
The legal theory that Cruz’s attorneys have used is that there are only two classes of citizenship: born and naturalized; anyone who qualifies as a Citizen of the United States at Birth is also a Natural Born Citizen. Thus far that legal theory has prevailed.

Ted Cruz didn’t issue the rulings on his eligibility, judges and state election boards did.
Like any other person, Ted Cruz has the right to test via the judiciary a legal theory: that anyone who qualifies as a Citizen Of the United States at Birth is also a natural born citizen. Thus far the courts have agreed with him.
There will be more legal challenges to come.

One something like Judge Hanen, perhaps.

I am not arguing that Cruz will be ruled ineligible, merely that if the best legal arguments, supported by logic, history, and precedent, were the only basis for decision, then he would be.

Obama was not born outside the U.S., and even if he was, unless I am mistaken no court ever considered it to be proven.

(And Obama was not anti-establishment.)

(Not that Cruz is, necessarily.)
