Hmm - likely drug-dealing Hummer H2 driver rear-ends a big Mercedes SUV. Sounds like he was trying to scare off a territorial rival.

If you're in certain types of vehicles in certain New Orleans neighborhoods, assumptions come into play. Well-founded assumptions, at that.

I don’t think the guy can walk easily under Stand Your Ground, if he had a firearm “under disability”

If he has been convicted of a felony gun charge in his past, or has drugs or alcohol in his system, or has been or is in the commission of a crime, he is not eligible for a SYG defense. (At least in most states. Not sure of LA.)

So, if a person is trespassing (i.e. been thrown out of a party) and comes back to confront the property owner and the owner punches him, he is not eligible for SYG.

Same goes if he had been drinking. You may not be “in control” of a firearm while under the influence and claim SYG. Though prosecutors may not block SYG if you were in your own home, drinking a beer, and someone breaks in...

I doubt the guy will walk.
