Rent to a Felon -- Or Else

The U.S. Department of Housing has just determined that refusing to rent to a convicted felon may be a violation of the Fair Housing Act, and National Public Radio seems to approve.

Felons are not a protected class (yet) under the Fair Housing Act, but since the American justice system disproportionately affects persons of color, it's racist to deny felons housing.

Note that HUD says may violate the act. That means, all you have to do as a landlord is ignore HUD and then battle it out in court. Feeling lucky? Roll the dice: 40% of the federal judiciary has been appointed by Obama.

I believe in redemption. A man pays for his crime and after he does his neighbors refuse him a place to live? That’s not my Christian faith. I’m sure folks have their reasons to pass on renting a house or apartment to a known felon, I just don’t believe in branding a scarlet letter on people. People do atone and move on in life.

Yep.

Three of them are tenants of mine.

That being said, make sure they are redeemed!

Not that I have any, but if I did, no way on earth am I renting to someone statistically some twenty-something times more likely to murder me than anyone else-probably being even higher if the felon factor is taken into account.

If someone has been convicted of rape, or murder (and I might possibly take into account what kind of murder it was, maybe), I just can't see knowingly putting myself and family in risk to rent to them. Especially if they're in a high recidivist group.

Are you kidding. That's the thing and why we're in the quicksand we're in. If anything, Republicans will compromise and fight only to exclude certain felons from renting, then they'll beat their chest in the election and brag how they fought the Dems on this issue.

I looked at one of those websites that checks sex offenders by zip code. Found out that there were three convicted child molesters living in family apartments near my house. It seems as though no one is paying attention and for those who do pay attention they get to go to court.

HUD regs only apply to property that is advertised for rent.

If one rents their property through word of mouth they can be a selective as they wish.

And right now there is only one person radical enough to actually try to give this an actual go.

And everyone on both sides of the uniparty is gearing up against him. None of them can control him.

And he is not perfect, or ideal. If he screws it up he is gonna be purged out too.

Right, my point was if you get a name and phone number on voicemail (as opposed to an application), then you can conduct a search before getting back to him based on the info you have. Then if you feel assured based on your search, you rent, if not, you don’t, and I don’t think he could use “I left a message and no one got back to me” as any kind of basis for a lawsuit.

PS - to make that work, only answer your phone if the caller ID shows it’s someone you want to talk to - all others go to voicemail ... which also helps avoid wasting time talking to phone scammers, telemarketers and pollsters.

Have you considered using an agency? Somehow you need to decouple your property from the vetting process. Have a third party do the vetting and send you only people that you would rent to based on their BG check. We have a vacation home on which we have had long-term rental inquiries. No way! We use a specific vacation rental lease in which the lessee agrees that 1) it isn’t a long-term rental and 2) they have to be out by a date certain. We only once rented for more than a month (3 months) and it was a nightmare to get the people out, because it was, under California Law, no longer a short-term rental.

Not being able to discern whether they are rehabilitated or not condemns the property owner to liability and potentially the neighbors to victimhood. The issue is, once again, that those who chose to break the law are being deified at the expense of those who didn’t.

Not allowing rehabilitated felons to live in safe neighborhoods condemns them to 2nd class lifestyles.

So, what's wrong with that? After all, they are felons.

How do they get redeemed? In prison, where they actually hone their crime skills?

Do you have any idea how hard it is to be convicted of a felony in a lot of jurisdictions in this day & age? Unless you have a pretty impressive record, everything gets pled down to a misdemeanor.

A felony is, by definition a crime for which the perp must serve one year or more in prison, not the local jail, but actual prison.

Sorry, but I have minimal sympathy for anyone who manages to get himself convicted of a felony these days.
