The U.S. Department of Housing has just determined that refusing to rent to a convicted felon may be a violation of the Fair Housing Act, and National Public Radio seems to approve.
Felons are not a protected class (yet) under the Fair Housing Act, but since the American justice system disproportionately affects persons of color, it's racist to deny felons housing.
Note that HUD says may violate the act. That means, all you have to do as a landlord is ignore HUD and then battle it out in court. Feeling lucky? Roll the dice: 40% of the federal judiciary has been appointed by Obama.

Makes me glad that I sold my rental property last year.

This is gonna drive private landlords and small landlord operators out of business.
Who would want to be forced to rent out a small house or trailer to a felon, they may just raise the rent to compensate for the risk of property damage or just not rent at all faced with having to deal with a greater chance of retaliation when trying to collect from over due rent from felon welchers.
People I know who saw rental properties as a moneymaker years ago have either sold them already or have them on the market now; very burdensome, with little real return...
Well, I guess the sex offenders will be clamoring for the rentals near schools...
So now you have FEDERAL AGENCY saying they will directly COUNTERMAND a local/state anti-child predator laws.....
If one has multiple contradicting laws, do we even have a "rule of law" anymore?
When one of those felons decides to rob, rape and murder their next door neighbor, the victim’s family will sue you and win in court because you knew who you were renting to.
Another Freeper suggested this. Purchase a federal firearms license for curios and relic firearms. Inexpensive. But then you are prohibited from renting to felons. Sounds like a good trick to me. Let them choke on the laws they pass.
Voicemail message: “Hello, the advertised apartment is available. Please leave your name and number ...” (and then if I can identify you on the net as someone I’d want to rent to, I’ll call you back).
So what can the feds do about that?
I believe in redemption. A man pays for his crime and after he does his neighbors refuse him a place to live? That’s not my Christian faith. I’m sure folks have their reasons to pass on renting a house or apartment to a known felon, I just don’t believe in branding a scarlet letter on people. People do atone and move on in life.
Of course doesn’t mean you forgo doing due diligence.
Unfortunately we own rental properties, a year ago a guy applied - I ran an internet search on him and he popped up on mugshot sites and newspaper articles all over the place...B&E’s...when he called if he got the apartment we said no.
No one else did either then, put the ad in again.
But with this ‘law’ he could sue. Ducky....

Not allowing rehabilitated felons to live in safe neighborhoods condemns them to 2nd class lifestyles.

A friend rented out a single family house in a nice area.
All was well for years, the tenant family dumped the husband for a new boyfriend parolee.
They liked to party too much for the neighbors.
Sometime between the eviction notice and actually leaving, everything possible inside the house was broken!
All the doors, appliances, sinks, toilets, drywall...
I helped him load the dumpsters.
That is the ultimate goal, to have Government as the sole landlord.
