As someone who has been involved in fighting these “child protective” agencies I can say unequivocally that all too often the case workers are simply vicious and evil monsters who destroy families for pleasure.
Why wasn’t it possible to prevail on the Choctaws to basically give her back. They sound like they want to place her with another non-Indian person anyhow.
People are being treated more and more like possessions. If this is a “for the chillun” idea, it sure got muffed. Why aren’t even liberals upset?
Most Caucasians and Asians and Melanesians have 1-5% Neanderthal DNA. I fear my grown children will be wrenched away from me and be forced to sit in the Museum of Natural History museum in the Neanderthal exhibit.

if you look at that tribe I think it actively excludes members from the rolls because of gambling money coming in. I would love to see some one sue who was prevented from being adopted by the tribe and then later told they were not members because they were not pure enough when they grew up. sue for there membership and sue for the damage done because of the missed opportunity to grow up in a loving family.
I’m thinking how many children in the US are not 1.5% Native American. Under this law, the Indians get to adopt virtually all foster kids.
I dread to hear why, though. It might have to do with the Choctaws not being allowed to learn about her former adoptive family or some other such B.S.
What could be a cool situation (hey honey, guess what, the Choctaw Indians are your godparents) looks poised to become a horrible travesty and tragedy.
About 10 years ago a friend of mine graduated from College with a degree in Engineering. He wanted to go to work for the State and have a cushy job. He took the test and came in first place but wasn’t hired. He was passed over by a less qualified African-American. He was really depressed about losing that job and I told him to fill out another application and claim Native-American status since he had one great grandfather that was Native-American. He said that he had no proof and only family rumors and I informed him that they never asked for proof that he was white did they? He did as I said and took the test and this time he came in 3rd but was hired. Asking him to prove his status as a Native-American and not asking that same proof of a white person or an African-American would be discrimination in my opinion.
I have a sick feeling that a few years from now we’re going to find out it turned out very, very badly for the child.
We ran into this with a child we helped place for adoption. The secret for the birth parents is this: NEVER mention any Indian ancestors.
I disagree, that is how these problems are created, when the bomb explodes later.
The sad thing is that as a practical matter it makes many children who are part Native American unadoptable and the tribe doesn’t give a rip about them until it becomes an “issue” and then they start asserting their “rights.”
If the girl is not going to be living with Choctaw family, what is the point of taking her away from her foster family? The federal law at issue is a blatant violation of the Equal Protection Clause of the Fourteenth Amendment (regarding State and local officials) and the Due Process Clause of the Fifth Amendment (regarding federal officials). The judge's gag order clearly violates the First Amendment.
All law enforcement officers have a duty to defy any order to enforce the Unconstitutional federal law or the Unconstitutional gag order. Just following orders is no excuse. Their job is to enforce the U.S. Constitution before anything else.
The family should go into hiding, so the girl can not be taken from it. This girl must be protected from a tyrannical government that has forgotten that "separate, but equal" is no longer good law.
1.5 percent translates to having 1 great-great-great-great-grandparent of Native Ancestry

It should be noted that President Reagan made NO EFFORT to end this terrible law, even though he took office only 3 years after it was passed.
I say this because people claim that “Trump is no Reagan”...with my point being that “Reagan was no Reagan, either”.
Trump will never be what we wish Reagan was, and we have to deal with that.
Yes — this is maybe even more baffling than having an actual Choctaw wanting to adopt her. What prevents “giving her back”?

So the little girl is 98.5% white, but it seems that counts for nothing? There is nothing these people like more than wrecking families. It is the just the same over here in the UK: there was a case where a mixed race married couple (one black and the other white) were refused permission to adopt because they didn’t “understand” racism!
Was there any chance the Democratic Congress would have voted to repeal this disgraceful law?
I seriously doubt that any “bomb” would explode if the kid is in fact less than 2% native American. The problem is that birth parents BOAST about even the most dubious Indian ancestry to inquiring social workers—and once it’s on record, the kid’s adoptability disappears.
That’s crazy.....my wife is 5-10 percent and I’m a bit too
