WASHINGTON The Republican Party's incoherent response to the Supreme Court vacancy is a partisan reflex in search of a justifying principle. The multiplicity of Republican rationalizations for their refusal to even consider Merrick Garland radiates insincerity.
Republicans instantly responded to Antonin Scalia's death by proclaiming that no nominee, however admirable in temperament, intellect and experience, would be accorded a hearing. They say their obduracy is right because:
Because they have a right to be obdurate, there being no explicit constitutional proscription against this.
Or because President Obama's demonstrated contempt for the Constitution's explicit text and for implicit constitutional manners justifies Republicans reciprocating with contempt for his Supreme Court choice, regardless of its merits.
Or because, 24 years ago, then-Sen. Joe Biden he is not often cited by Republicans seeking validation suggested that a president's right to nominate judges somehow expires, or becomes attenuated, in a "political season," sometime after the midterm elections during a second presidential term.
Or because if a Republican president tried to fill a court vacancy during his eighth year, Democrats would behave the way Republicans are behaving.

Hey George, isn’t it hard to see and hear with your head that far up your ass?
Time for the pasture George.
I’ll bet his bowtie is a clip-on too.
STFU George
George won’t figure out that it’s a fight until he’s tied to a post with a blindfold and a cigarette.
Let’s give Trump credit for one thing: he has outed all the phony conservatives. Will, Barnes, Kristol, Krauthammer, etc. - liars one and all. There’s will be the Eighth Circle of Hell reserved for fraudsters.
The Supreme Court is whatever Congress says it is. Senators aren’t obligated by the Constitution to vote any particular way, or at all. Why some people want to make this any more complicated than it needs to be is beyond me.
OK, lets consider him.
Is there any chance at all that Garland is a constitutionalist?
If he was, Obama would not have nominated him.
If he isn’t, then he has no business being on the Supreme Court. A Supreme Court justice who isn’t a constitutionalist is a fraud. Yes, I realize, we already have several.
So, how long will it take to give Merrick due consideration and then dismiss him as unqualified? Do we really need to go through this empty motion? Has Obama ever nominated a constitutionalist to the court, or to any other position in government?
George Will articles should come with a barf alert. He is a 5th columnist cancer to true conservatism.
when the heck are the GOP going to come out and state that because Merrick is against the second amendment that that position disqualifies him from office since the second amendment is is such an integral part of our nation’s constitutional rights? The GOP should be hammering home the fact that this judge is hostile to our constitution, and therefor has no right to be a supreme court judge
The intent is to make him a non-person under non-consideration. Your idea is counterproductive.
Is there an award for the worst useless pundit?
Will exhibits the classic aristocratic and patrician view towards the inferior classes.
He is nothing more than a self-important, patronizing snob, and the perfect epitome of loathsome DC arrogance.
Good Lord. You know what, Will? Just freakin’ die.
Scary to think about - the George Will of 20 years ago WOULD NEVER have written something like this...it’s got to be age-related.
Denounce this nominee for his ability to interpret the constitution, rather than following it
George will burn in hell
To them he is one
I have been a Republican most of my life (I’m 86), but if
the Republicans back down on this, I shall register as an
Independent!
13 minute video reveals that Trump “GETS IT.”
This is why the oligarchs are suffering embarrassing bouts of public diurnal enuresis.
There will be MANY MORE attempts on Trump and his family. I just pray they FAIL and the criminals responsible face justice (but I’m not holding my breath).
I haven’t been an Alex Jones fan as his stuff tends toward the sensational. That said, hearing that there REALLY IS a plan in place to take over the world can be rather sensational to folks who hear it for the first time and/or suffer severe guilt for knowing it — and have done nothing to resist while knowing that their children and grandchildren will be denied the birthright THEY inherited!
Now — thanks to Trump — that that plan is becoming clear to millions of folks, Jones is becoming more mainstream every day.
