Why The Latest Shocking News From The FBI About Clinton’s Emails Indicates She’s Going To Jail
Independent Journal ^

Posted on 03/07/2016 9:20:06 AM PST by Hojczyk

This development is significant for several reasons and points towards potential legal problems for Hillary Clinton in the very near future.

First, Mr. Pagliano would only need immunity from prosecution if he had broken the law.

Second, immunity can only be granted by Federal Prosecutors, so the criminal investigation into Mrs. Clinton’s private email server is far more advanced and serious than anyone in the U.S. Government has publicly acknowledged to date.

Third, the Justice Department would only grant immunity if information that Mr. Pagliano possesses about a more significant crime outweighed the crime that he committed and if it was in the public interest to do so.

It begs the question — What does Mr. Pagliano know that makes him worthy of immunity?

Well, Mr. Pagliano’s connection to the case is that he set up and maintained the email server at Mrs. Clinton’s request, so whatever information he has is more than likely about Mrs. Clinton herself and pertains to the ongoing criminal investigation. To date, the investigation has revealed that Mrs. Clinton and her top aides were found to have sent and received over two thousand classified emails that all went through Mrs. Clinton’s private server in what appears to be a violation of U.S. law. What remains unclear is Mrs. Clinton’s true motivation for using a personal server in the first place.

Mrs. Clinton has publicly claimed that she did so as a matter of convenience. However, her detractors question whether she did so in an attempt to circumvent the federal records act knowing that she was going to run for President.

How about concealing bribery and tax evasion?

Does anyone remember the post that showed-via email to her chief of staff- to strip the headings of a document then send it to her personal home brew server.
That witch damn well knew what she was doing. And directed her subordinates to break the law.
She can’t claim she didn’t know how or why those TS/secret/confidential emails showed up.

I ain’t saying she will be indicted but she will be asked those questions if she gets the dem nod.

Andrew Napolitano has been saying the same thing, and iirc, he has been both a lawyer, *and* a judge. Is that credible enough for you?

It would be ... if the good judge had any track record of being right.

Would explain why she is so belligerent, yet cavalier, about this.

She knows it ain’t going anywhere.

"I don’t think that a pardon can be issued absent a conviction (there’s nothing to pardon)"

A President can pardon anything but Treason. Ford pardoned Nixon for anything and everything, without a formal charge, let alone a conviction.

Oh, heck. At first I thought you found the silver bullet. Indict Hillary for treason. But I looked it up and I think you're wrong. From Wikipedia:

In the United States, the pardon power for federal crimes is granted to the President of the United States under Article II, Section 2 of the United States Constitution which states that the President "shall have power to grant reprieves and pardons for offenses against the United States, except in cases of impeachment".

Oops, sorry, you’re right. I remembered that there was a single exception, but misremembered want that exception was.

As far as I’m concerned, what Clinton did was treasonous.

Not targeting the original poster, but this seems to be a compilation of existing stories from the last three days.

Not a lot of new news coming. It is almost like someone is leaking the stories intentionally. /sarc

The trouble is that Obola is sitting, wearing a figurative political/legal bomb vest and the Witch holds the trigger. If Obola pulls the legal trigger on the Witch, she’s sure to hit the detonator button on his vest. Hence, ValJar’s hate for the Witch isn’t likely to mean much unless she can deactivate the political/legal bomb vest the Witch has attached to Obola.

Another thing to note, if they have given him immunity, he can’t “plead the 5th” again, he will have to testify, or go to jail for contempt until he does.

Would be if the Department of Justice wasn't politicized.

It depends on whether Obama thinks Hillary is the only Democrat who can win, or if he thinks someone else could do so (Bernie, Fauxcahontas, or Biden), and that he could throw Hillary under the bus without her being able to inflict a lot of damage on him. He hates Hillary but wants a Democrat to be the next President so that his own "achievements" are not rolled back, and so that the SC will have a permanent left-wing majority.

That’s not how immunity works. The agreement only stands if he testifies against whoever they are going after (Clinton obviously).

If that doesn’t happen, then the immunity agreement is void. He also can no longer refuse to testify on the basis that he would incriminate himself.

Nothing is going to come of this

I believe, this time, you're wrong.

Whatever the DOJ decides is secondary in terms of "how damaged her candidacy becomes."

WE are wending our way toward a MOST interesting moment in Political History.

Watch this short interview with Judge Anthony Napolitano. Very INFORMATIVE.

The "Historical Political Moment" I'm alluding to is pointed out in the final 30 seconds of the video by the Judge.

Judge Napolitano: There Will Be An Indictment Before November Elections

Even if the classified material issue can be dodged, and I doubt it can, she is not above the law, this could still get away from her.

If the motivation or “convenience” for having the private server was in any way related to Hildabeast’s intention to run for President, then this may have legs.

Obama made Hillary SecState to “...keep his enemies closer”, and Hillary was promised. A lot of things. One of which was protection, IMHO. Indictment or Pardon, if she is denied her presidency, SHE just might be granted immunity in her exposure of greater crimes with bigger fish...But... The potential collapse of the Clinton dynasty and the Obama nightmare in one massive scandal is probably too much to hope for.

“Third, the Justice Department would only grant immunity if information that Mr. Pagliano possesses about a more significant crime outweighed the crime that he committed and if it was in the public interest to do so.”

Normally this would probably be true. But with this justice department it could be a ploy to actually silence a witness. The guy only has to answer a question that they actually ask. And if he has immunity then no one else will be able to ask him questions.

She’ll take the pardon and Elizabeth Fauxcahontas Warren will step in.

Book it

I'd bet your wrong.

If Hillary becomes seriously "damaged goods" the Democrats will hold a BROKERED convention and wheel out Joe Biden to be the nominee to save the day.

“Does anyone really expect that a far left democrat president and Attorney General are going to indict the democrat nominee for president just a few months before the election?”

Depends on whether they have someone else in mind to replace her. That’ll be a balance between how badly they think she will lose, her effect on the downticket, and whether they figure they are going to lose this year and so let her take the defeat. If they want he off the ticket, she’ll be indicted. If not, she won’t.
