ew York appeals court denied Fox News host Bill OReillys petition seeking custody of his two children, Gawker reported on Monday.
The courts Feb. 24 ruling upheld a Nassau County Supreme Court decision granting full custody of the 12-year-old boy and 17-year-old girl to Maureen McPhilmy, the Factor hosts ex-wife.
Viewing the totality of the circumstances, there is a sound and substantial basis for the Supreme Courts determination that it is in the best interests of the children for the mother to be awarded primary residential custody, the Appellate Division Second Judicial Department court stated. Particularly relevant in this case are the clearly stated preferences of the children, especially considering their age and maturity, and the quality of the home environment provided by the mother.
Court transcripts published last May showed that the girl told a court-appointed psychologist that OReilly was choking her mom or had his hands around her neck and dragged her down some stairs.
The psychologist, Larry Cohen, also testified that the daughter told him that OReilly described McPhilmy as an adulturer, and described McPhilmys new husband as not a good person.
According to Cohen, the daughter said OReilly told him that, if she spends her time or more time at the mothers home, it will ruin her life.
OReilly and McPhilmy divorced in September 2011 and originally agreed to split custody of the children.

mom was 35.
it’s funny, you never know the post that is going to end up getting a bunch of responses :)
I see i’m not alone with the older than usual parents things :)
I am not a BOR fan. Just agreeing with the FACT that some kids will lie for their parents. I don’t know anything about the kids or ex-wife.
Having been the child of divorcing parents....twice...at age 13 and again at age 19...no comment
lol. Yeah. With all the nasty political talk lately, I needed a break.
wow. that would be six years from early retirement today :)
great dad I had, but always wore a collar and tie. i’m 47, the age when he had me!, and the other fathers were all wearing jeans. :)
No matter what one thinks of BOR, fathers don’t usually get treated well in custody disputes. Both mom and dad should encourage the children to respect the other and spend time with the other (its good for the kids)...unless one is just an absolute dangerous degenerate.
I hear ya ;)
Well when BOR’s wife left him for a Long Island police detective who she subsequently married BOR tried to bribe the Police Chief to demote or get rid of the detective. It all got found out and BOR barely escaped criminal charges. He’s an azzhat with a really bad Irish temper. No doubt his kids don’t want to live that.
Great minds FRiend, great minds! lol
You have now confirmed my suspicion that you started drinking early today.
Exactly! I wish one of the candidates running for president would address that.
They would win in a landslide
Yes, no good way for this to work out for the kids. The courts in MA did that in my family’s custody battle in 1974. We chose my dad but that caused a lifelong rift with my mother.
It would be really good if people sucked it up and tried harder to stay married. That said, if it is a case of mental or physical abuse, get out. But I suspect in most cases, it isn’t that.
“About all I can say that it is now highly likely that the ex will now get some pretty damned big child support payments from him. I guess she filed for that the minute the ink was dry on this order.”
No need to file - she’s Primary Custody so he’s automatically on the hook.
I think it’s a lifelong schtick that’s become habit.
Well, I was going after the practical implications. In both cases, you are no longer married, are free to marry someone else, even if you’ve been together for 25 years and have kids and property in common.
