It’s time to start speculating about Donald Trump’s vice presidential pick

On "Morning Joe" Tuesday morning, host Mika Brzezinski threw out an interesting theory: Donald Trump and Marco Rubio are playing nice with one another — and savaging Ted Cruz — because a backroom deal has been cut between the two to form a ticket with Trump as the presidential nominee and the Florida senator as the second in command.

I don't think that deal has been cut. But Brzezinski's speculation did get me to thinking about whom Trump might pick as his vice president. (For those of you who think such speculation is premature, I say (1) it sort of is and (2) read this.)

The 12th Amendment states: “The Electors shall meet in their respective states and vote by ballot for President and Vice-President, one of whom, at least, shall not be an inhabitant of the same state with themselves.” Thus, the New York electors cannot vote for both Trump and Giuliani, and, had Cheney not relocated to Wyoming, the Texas electors could not have voted for both the younger Bush and Cheney.

The Constitution does not say the President and VP cannot be from the same state. It says that the electors of a state can’t vote for a President and VP both from their own state. Thus, if Trump chose Rudy, they could not win NY’s electoral votes, thereby making Rudy a dumb, but not unconstitutional, choice.

Agreed. No one I know here in South Fla can stand Rubio anymore. We’ve gotten to know him too well: he’s a total phony. And Rick Scott? Puh-leez. He barely won re-election. And that’s the best thing I can say about him.

Both Giuliani and Trump are residents of New York. Per the Constitution, the President and Vice President cannot be from the same state. One or the other will have to change their residency, as Cheney did, moving to Wyoming from Texas before becoming the younger Bush’s Vice Presidential pick.

Actually, there is nothing in the Constitution which prohibits the President and Vice President from being from the same state. However, if the President and Vice President are both from the same state, the electors from that state cannot vote for them in the Electoral College. Thus a Trump/ Giuliani ticket if it could carry New York State still wouldn't get the electoral votes for New York.

Cruz & Rubio are both ineligible! Trump has raised that issue about BOTH of them. He can’t choose them for veep.

Trump doesn't waste talent. Would you rather have Cruz as Veep at the time of choosing a Justice. Or V.P. Rubio?

There is a weird delusion among non-NYer Trump fans that The Donald is popular in NY, like some kind of favorite son. That is in error. Those of us in the NYC media market have been subjected to his act for 25 years, through the whole front page cheating on his wife with Marla scandal and his sporadic goofy drama over the years. Most NYers don’t take him seriously, despite his NY values.

If he picks Rubio he has to explain why he thought he wasn’t eligible for the presidency. From Rubio’s standpoint I have no doubt he’d jump at the chance. He needs the job.

Then the question is whether New Yorkers prefer Trump or Clinton, local or carpetbagger, creater of jobs or leaker of secrets, cheater in marriage or an enabler of a cheater in marriage.

Cruz is too smart to hitch his wagon to the coming Trump presidential train wreck. He'll be in a good position to sort through the wreckage and pick up the pieces.

In the entire history of the country, the only VP candidate on a losing ticket ever to come back later and become President was Franklin Roosevelt. Cruz should consider this. If he stays off a losing Trump ticket, Cruz could come back and be "next in line" in 2020.

I guess you're right, but New York's electoral rates are too large to give up, just as Texas was for Bush/Cheney.
