Ted Cruz birther lawsuit makes it to Cook County courtroom

Not along ago, Illinois pharmacist and attorney Lawrence Joyce began to realize his country and his political party were facing what he considered to be a nightmare.

Concerns about the eligibility for the presidency of Republican candidate Sen. Ted Cruz, Texas, who was born in Canada to a Cuban father and an American mother, were raised by rival Donald Trump. Though they may at first have seemed laughable, the legal case against Cruz was one Joyce, a Ben Carson supporter, thought he understood.

The Constitution requires the president to be a "natural born" citizen of the United States, and as far as Joyce is concerned, Cruz isn't one.

Cruz will lose.

MR. JUSTICE GRAY, after stating the case of United States v. Wong Kim Ark, delivered the majority opinion of the court:

Every person born in the United States, and subject to the jurisdiction thereof, becomes at once a citizen of the United States, and needs no naturalization.

A person born out of the jurisdiction of the United States can only become a citizen by being naturalized, either by treaty, as in the case[p703] of the annexation of foreign territory, or by authority of Congress, exercised either by declaring certain classes of persons to be citizens, as in the enactments conferring citizenship upon foreign-born children of citizens, or by enabling foreigners individually to become citizens by proceedings in the judicial tribunals, as in the ordinary provisions of the naturalization acts.”

Cruz has to be a naturalized citizen.

Being born in the United States makes this very different. We have never had a foreigner as President and hopefully we don't start. It would open the door to having Presidents born from North Korea, Iran, or Indonesia. Who wants that? No thank you. Only people born within our 50 states should ever be President.

I posted links to two or three news reports post 276 of "Bad news for Ted Cruz: his eligibility for president is going to court", as well as at posts 277, 287, and 291 of that thread.

Hearings in Indiana were scheduled to start at 1:30 pm Eastern Time. There are ten ballot access challenges on the Feb 19, 2016 Agenda.

Nope. Kim Wong Ark is the most gratuitously wrong case ever decided by the US Supreme Court, and no I don’t exclude the Dred Scott decision. Justice Gray was compromised and wrote a decision that was wrong on the law and wrong on the facts. This crap decision led directly the the ‘anchor baby’ travesty.

BTW, a child born outside the territory of the USA is not therefore also born “outside the jurisdiction of the United States” and can naturally inherit citizenship via the parent(s). No statute law necessary.

Cruz is not naturalized, he’s a natural natural all the way to the bank.

They were raised before Trump mentioned that Cruz’s position was —precarious—Which it is. Cruz should settle it asap!

The Indiana election commission has rendered its decisions too.

Presidential candidates Ted Cruz, Marco Rubio stay on Indiana ballot, commission rules

On Rubio, Election Commission member Anthony Long, of Boonville, said he thinks common law makes it clear: Someone born on U.S. soil to parents lawfully in the country is a natural born citizen. Yet, Long, a Democrat, questioned whether Cruz's mother really was a U.S. citizen, though he ended up supporting the defeat of the challenge.

Rubio's challenge was rejected 4-0, while the Election Commission denied the Cruz challenges in a 3-1 vote.
