According to the Constitution, the President can make appointments of ALL officials when the Senate is in recess.
The fix to that is simply not to go into recess.
If they truly want to oppose President Obama from placing a liberal to very liberal to totally whacked-out Leftist on the Supreme Court—to replace a well-known conservative, they have every right to do so, and the Constitution provides them with the tools to do so.
They can chose whether to go on recess—or not—anytime a majority so decides.
Right now, the majority is nominally* Republican. If they stick together, then they can effectively stop this president from making a non-conservative appointment.
* Nominally—and I think we have to watch McCain, Kirk, Collins, Heller, Hatch, Cronyn, Graham and Murkowski. They’re all either Liberals or bending over backwards to get along and not get a press beat-down.

Trump is responsible for making this Presidential campaign interesting and with substance. Most people on this forum know in their hearts, we need drastic measures to overcome
the left wing take over of our country. I am happy the Republican Party is learning how to street fight, because the selected candidate must be strong enough to stand up and fight hard. Republicans know first hand what happens when weak candidates are elected.
If you are a lawless president like 0 seems like at recess appointment especially one that Congress cannot alter until the next president would just be perfect I’ll be amazed if he doesn’t do it is that how it works?
Hey SC, that also applies to the Supreme Court. They are not in session during that time, or certainly don’t have to be.
So even IF Obama makes a recess appointment then, the appointee will never vote a single time in those 3 weeks, and will be officially out when the new Congress is sworn at the same time.
The only fly-in-the-ointment to all this is if the democrats win in November. Then the country might as well be lost.

The real loser in the debate last night was the crowd. Would the Dems ever stack a crowd against one of their candidates like that? Why were they never told to shut up?
Every time Bush or Rubio would burp there was a 5 min cheer.
That then would be an EXCELLENT time for Trump to go after McCain again, and go to Arizona and campaign for his opponent in the primary. He oughta privately tell McCain to check his six, because if he spouts off like that, Trump’ll be “Fox One” at him!

I see two reasons why zero might not do a recess appointment.
one is his legacy. It would look bad really bad and the other is that Roberts is already in the bag for the regime.
The way I hear it he can do a recess appointment anytime Congress is in recess I think I may be in recess right now not sure
