Come January 2017, Republicans have a chance at controlling the House of Representatives, the Senate and the White House.
So it stands to reason that Republicans have very little incentive to even consider President Obama's suggestion for who should replace Justice Antonin Scalia, who died Saturday.
There's some historical precedent for them to do just that. A hazy rule dating back decades that congressional experts say is really more of a tradition suggests senators of the opposition party of the White House can oppose some judicial nominations in the months before a presidential election

The Senate will have to skip any recesses they had in mind or Obama will make a recess appointment.
No, what I am scared of is the current recess.
I wouldn’t put it past Obama to make a recess appointment tonight.
Somehow the pubbies will find a way to snatch defeat from the jaws of victory.
She should be at the top of the list of any Republican candidate.
There is no mechanism for a recess appointment to the Supreme court so please stop trying to say there is. You are not advancing the discussion here. How many times do you have to be told?
STFU! I that clear enough?
They can. The question is, will they...
Let’s face it, we can think of a number of Republicans who don’t surprise us when they side with the `rats.
Right now I’m just upset over the news. I liked Justice Scalia.
The Senate had better goddamn well block any nominations until a new President is elected.
God bless Antonin Scalia and may he RIP.
I agree ... but unfortunately the Dims have gone into instant political mode as usual ...
Justice William Brennan was appointed to SCOTUS by President Dwight D Eisenhower in 1956.
That’s a fact.
Look it up.
I will not S/U, with or without the F, when I am correct on a matter of historical record.
Who the heck are you to tell anyone to STFU.
Actually I think the the senate will block any nominations til after the election as it won’t cause them that much heat.
It would sure be nice if McConnel would keep his word for once. But, once a liar, always a liar, once a traitor, always a traitor. So his words are meaningless.
On the other hand, I would not mind if Senate RINOs did confirm an Obama nominee so that patriots would fire as many Senate RINOs as they can on election day. The Senate would then hopefully have enough votes to remove House-impeached, state sovereignty-ignoring activist justices from the bench.
Can they, sure... Will they? They haven’t fought Obama with no mercy once... So color me doubtful.
Its not about Republicans ‘Growing a Pair”, its about the deal Obama offers them. If Obama offers the Republicans a Large Tax cut for the wealthy, and a amnesty Judge that can claim is “Middle of the Road”, then like the good traitorous scum they are, the will make the deal.
They could delay, and then hold hearing in the Judiciary Committee, then vote the nominee down in committee, Bork a Dim nominee for a change. Do it again.
But with some of the squish Republicans we have on the Judiciary Committee, who knows if they would all work together and deny Obama this nomninee. They damned well should.
They sure better not even come close to confirming anyone.
