Second is that Roberts doesn’t need to hear any more cases this year unless he thinks it absolutely necessary, and then it will be a 4-4 balance court.

In the unlikely event that the GOP Senate holds its ground and refuses to confirm (McConnell would never do that to his buddy) — watch for Obama to have the audacity to make a recess appointment, knowing that the GOP Congress will never fight him on it.
If this was a dem senate and a rep WH almost certainly to flip to dem....the dem senate would stall for a year until the new dem president could make an appointment. This case is sadly all to predictable....there will be a parade of idiot R senators, probably led by McCain, begging to be bipartisan and reach across the aisle and all that crap. According to precedent per the 1968 election, the pick of a new Supreme Court justice is made by the next president.
The Senate can delay this until a new President is sworn in. Its not a problem unless they make it a problem.
There is no precedent for confirming a Supreme Court Justice during a President’s lame duck year. George Washington nominated a few who got confirmed in his last year in office, as did Andrew Jackson (the last time it happened). He had 2 justices confirmed in the Spring of 1836 (1 was Roger B. Taney) and 1 confirmed 2 months after he left office, but since his successor Martin Van Buren was also a Democrat, I’m guessing Van Buren had no objection.
FNC reading McConnell statement saying Scalia replacement should not be filled until new president is elected. Of course, putting out a statement and what he actually does are two very different things.
