If the Republicans rush through a n Obama nomination watch the Court go into special session to take up a host of newly minted cases to end the Republic before November. The Court does not have to take things as they come up through the lower courts. It can take things out of the air as it were.
As far as taking cases....what you're saying is Not how the court works....Geez....
