Rubio it’s called the Geneva convention.
You can’t openly torture people. Plus when people are tortured they will say anything to stop the pain. It’s pointless and what the bad guys do.

"Torture" works. It always has and always will. The only question is what limits you put on interrogation. We have non-state actors who are not party to the Geneva Convention. They did this to us:

Terrorist don’t wear uniforms and they do not subscribe to the Geneva Convention. It’s fair game and open season. Not only that but waterboarding does work... so say those who actually applied it.
