In a major victory for gun rights advocates, a federal appeals court on Thursday sided with a broad coalition of gun owners, businesses and organizations that challenged the constitutionality of a Maryland ban on assault weapons and other laws aimed at curbing gun violence.
A three-judge panel of the U.S. Court of Appeals for the 4th Circuit said the state's prohibition on what the court called "the vast majority of semi-automatic rifles commonly kept by several million American citizens" amounted to a violation of their rights under the Constitution.
"In our view, Maryland law implicates the core protection of the Second Amendment -- the right of law-abiding responsible citizens to use arms in defense of hearth and home," Chief Judge William Traxler wrote in the divided ruling.
Provisions that outlaw these firearms, Traxler wrote, "substantially burden this fundamental right."

Anything that looks "scary" to a liberal.
A frying pan, if you come home late after drinking with friends.
Don’t ask me how I know that.
“So these lawyers in D.C. think Americans have a right? Thatâs mighty nice of them. It appears they havenât a GD thing better to do than discuss what weâve all known for hundreds of years.”
Apparently the article went right over your head ...
If you believe in the Constitution then under the 2nd amendment you have the right to own any kind of weapon!!!
When does Obozo go to the microphones to claim this ruling is unconstitutional.
Pathetic POS.
What part did I not get?
Federal law requires plug in large cap shotgun mags
Three I think is max
For migratory waterfowl hunting
Just saying
Many states regulate shotgun capacity for various game as well and most are three is the limit in semi autos
But yes the second amendment is not about hunting or self defense
It’s about existential threats and tyranny
Take your time.
“What part did I not get?”
1. That there was a law that infringed our constitutional right.
2. There was a legal case BROUGHT to the judges by pro-gun groups to overturn the infringement.
“Take your time.”
Sorry for taking four minutes to respond. Fortunately, my life does not revolve around you.
Notwithstanding, a gun falls under the definition of an ‘Arm’, in a much as a ‘firearm’ or taser (each having their own sub-definition).
No offense to you specifically, but I loathe the attempt at parsing the Left.
SCOTUS can attempt to parse ‘gun’, but must fall under the general term, for which the definitive is absolute: “shall NOT be infringed.”.
A single page to the court, VERY few lines:
- The 2nd re-arms the INALIENABLE Right of We the People
- That for which has no specific authority (IE: infringe), all laws are null/void.
Case. Closed. Let the chips fall where they may. It would come as a surprise if they ruled against? What would that accomplish but being driven underground and/or a 2nd Revolution (LONG past time, IMO)?
The courts should never have been given this much power. It’s absolutely insane that everyone has to hold their breath whenever a bunch of black-robed political puppets get to decide whether or not we get to keep our Constitutional rights.
This is nothing new. It's a con game. Was it not lawyers in D.C./states who've created 27,000 gun laws and essentially looted the 2nd Amendment?
Why is we have to continually beg and lawyer up, giving all these folks lucrative careers, just to keep the rights we've had for hundreds of years? If we have legitimate leadership, all these bull shit legal cases going back decades, would never see the inside of a court to begin with. So many laws they've created it's burdened the tax payers just to play these asinine legal lawyer games.
Very interesting and valid point.
Years ago (I forget where...maybe it was here?) I read about some GIs who went back to Vietnam long after the war was over, and they met up with their former associates. Somehow it turned out that the top VC informant in the area was...the local barber, that all the GIs went to.
And, here, I believe is how/why we’d lose the war (excuse the pun). The Left wins by focusing on the minutia.
‘...shall not be infringed’ > Arms > weapons > firearms > guns> pistol/rifle/shotgun/pea-shooter > assault-weapon
We should be striving to bring it up a notch/or two or three...
for game.. yes
I have 20 round drum because I can
I do a dump once every few years just to see that it works
Bingo
Thank you. and that is the wider point.
Thank you. and that is the wider point.
I believe you.
There should be a law!
