Donald Trump stepped up his attack on Ted Cruz on Monday, tweeting that the Texas senator needs to "either settle his problem" of having been born in Canada or leave the race.
"It's time for Ted Cruz to either settle his problem with the FACT that he was born in Canada and was a citizen of Canada, or get out of race," Trump tweeted Monday morning, on the heels of Fox News polls released over the weekend that showed him with double-digit leads over Cruz in both Iowa and New Hampshire.
Trump has insisted over the course of the last month that Cruz needs to tackle the issue of his eligibility because he was born in Calgary, Canada, despite Cruz's assertions that he is eligible based on the fact that his mother was born in the United States. Cruz renounced his dual Canadian citizenship in 2014, a fact that Trump has frequently pointed out as cause for concern.

Of course, but the principal sponsors of the 14th Amendment, particularly Bingham, for example, stated that there was no intention of the part of the Congress to alter the Section II presidential eligibility clause. You could check the Congressional Record. There is also the evident fact that the purposes of the 14th Amendment was to make it clear that black Americans were citizens who could not be deprived of or denied all the rights of citizenship. It is also clear that the 14th Amendment affected citizenship, not natural born citizenship as set out in the presidential eligibility clause.

"There are two sources of citizenship, and two only: birth and naturalization." Bustamante-Barrera v. Gonzales, 447 F.3d 388, 394 (5th Cir. 2006) (internal quotation marks omitted). "Within the former category, the Fourteenth Amendment of the Constitution guarantees that every person 'born in the United States, and subject to the jurisdiction thereof, becomes at once a citizen of the United States, and needs no naturalization.'" Miller v. Albright, 523 U.S. 420, 423-24 (1998) (quoting United States v. Wong Kim Ark, 169 U.S. 649, 702 (1898)). "Persons not born in the United States acquire citizenship by birth only as provided by Acts of Congress." Id. At the time of Thomas's birth, Congress extended birthright citizenship to children born abroad to one citizen However, it is undisputed that Thomas was not a statutory birthright citizen because his father did not meet the physical presence requirement of the statute in force at the time of Thomas's birth.1 Id. Consequently, Thomas must rely on the Fourteenth Amendment, which provides, in relevant part, that "[a]ll persons born . . . in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside," U.S. Const. amend. XIV, S: 1, to sustain his claim that he is a birthright citizen. Thomas contends that the military base located in modern-day Germany where he was born was "in the United States" for purposes of the Fourteenth Amendment.We disagree.

3.Pro Traditional marriage. "Gay rights is not my thing." FALSE, it may not be his "thing", but the Donald is on record as saying he will not fight on the gay rights issue
4.Pro capital punishment "Capital punishment isn't uncivilized; murderers living is" If Trump is honest on this issue, this would be a more conservative position
5.Hold Judges accountable How will you do this Donald?
6.Opposes "Common core is a disaster" Teach citizenship, quit "dumbing down". That's nice Donald, but a conservative would recognize this as a STATE issue
7.Anti education unions (2000) That's nice Donald, but a conservative would recognize this as a STATE issue

Cruz is going to, in fact, get hearings. His lawyer’s will argue that the cases should be dismissed. On the merits, he “makes his case” without cite to any authority.
I realize that. And that is, under the circumstances, a good thing. However....attacking the only conservative, by questioning his eligibility, in the race is not a good thing. It’s not up to Trump to do what he’s doing....ie questioning Cruz’s eligibility. He is marginalizing and destroying Cruz’s campaign (or trying to). For that, I seriously doubt that I (and many more voters) will be able to forgive and forget, should Trump win the nomination.
The goal is to defeat the Democrats this November, or at least that’s what I thought the goal was. How, exactly, is what Trump is doing re: attacking Cruz in this manner helping towards that goal? Answer: it isn’t. It’s dividing and destroying the GOP’s chances of winning. So my other question is.....”what if” this was the reason and motivation behind Trump running as a Republican all along....?
