GOP presidential candidate former Pennsylvania Sen. Rick Santorum says that fellow GOP candidate Sen. Ted Cruz (R-TX) is "misinforming the public" about him being a "natural born" citizen and eligible to run for President of the United States.

The Des Moines Register's politics reporter Jennifer Jacobs posted on Twitter:

Ted Cruz is "misinforming the public" by saying "natural born" issue is "settled law," Rick Santorum says in Iowa. Supreme Court must rule. -Jennifer Jacobs (@JenniferJJacobs) January 13, 2016

You have provided one academic paper.

I have provided specifics including: the text of the statute itself, the history of U.S. naturalization statutes, the precedents in Bellei and in Minor, the dicta in Ark, an example from history - the case of Churchill.

SCOTUS precedent is reality. The text of the statute is reality. History is reality.

Do your own research. It really is not that hard. Put in ‘original intent’ of the Constitutional phrase ‘natural born’...

Now there are a bevy of people all across this nation on both sides of the political spectrum that do not care for that requirement ‘natural born’, but thus far you are not going to find ‘case law’ or acts of Congress that has touched it... Cruz knows darn well he does not fit the ‘original intent’ of ‘natural born’.

They demonstrate that Cruz is a naturalized citizen. The statute in force at the time of birth controls. The statute in force in 1970 granted the status “citizen”.

A naturalized citizen is not eligible to be president.

I ask again, if Ted’s campaign has his CRBA and birth docs, why doesn’t he release them and help resolve the issue?

- Perhaps Mom was a Canadian citizen after all, and Ted does not have a CRBA.
-Perhaps he had to apply for US citizenship via naturalization.
- Did he enroll at Harvard as a foreign student?
- Does he travel on a US passport?

AND that there are REAL issues facing this country and threatening its future existence. Trump's support (along with any of the viable candidates) for slamming the door on the flood of illegals is a good start but ONLY a start and his 2nd Amendment position is credible and also a good start but the wall is not the be all and end all that his supporters imagine. There are MANY other issues and where Ted Cruz was born, given that his mother was an American citizen by birth, is NOT one of them.

Some people have wasted seven years whining about Obozo's status when they could have been wrecking him and his agenda politically but NOOOOOO, they just want a magic bullet to avoid all that work. If this continues, can you say President Hillary? You will have to learn.

I don’t care who you expect it from, Trump is not now, nor has he ever been a “conservative” and it appears it is you who is “thin skinned”.

Neither Trump or Santorum are in any way brave for bringing up this ridiculous NBC. What they are is stupid. I accept the explanation from a true conservative constutionalist, Mark Levin. I realize all of a sudden he is also being called names here on FR but that doesn’t make him wrong. In fact, from what I’ve seen lately, that makes him right.

Being surprised that people on a conservative website would be supporting a man who has/had no problem with partial birth abortion and gay marriage seems normal to me.

Even though I’m from Oklahoma, I can still read the King’s English. Perhaps you should have an adult read the pamphlet to you before your nap.

The Constitution requirement for president is ‘natural born’... Cruz’s mother could not give her son ‘natural born’ standing, that standing can come only from citizen father. So it does mean something. Cruz is NOT eligible to hold the office of president and he knows it. He claims to be for ‘original intent’ but exempts himself.

If he will two time the Constitution to serve himself, he will two time US if it suits his pleasure. We do not need any more Harvard law schooled presidents...

No, Springfield Reformer seems to be taking the quite conventional view of NBC, birth IN the US AND/OR birth anywhere to at least one citizen/parent suffices. No magic decoder ring required, no paperwork, just the facts. Lawrence Tribe is your strawman. There is a constitution. It is a live constitution but the words of it remain the same unless amended. The right to slaughter the unborn is NOT in it. Nor is perversion posing as "marriage." NBC is in it but not as Birthers would define it and restrict it.

Extreme Birthers think that to be a NBC, a candidate must be born here and have TWO parents who were NBCs. Whoops! Trump's mama was born in Scotland as a British subject. Last time we ignored that, we got Obozo. Though I despise Obozo, his NBC status is not REALLY in question despite all those Birther court actions trying in vain to get the courts to provide the magic bullet to leave them in their indolence. Nor, obviously is Cruz's NBC status in question. He is an NBC even if that makes Trump's supporters have to defend their candidate against Cruz on the full range of conservative issues---a truly formidable task.

Cruz is my guy. Obozo is not. Trump may someday be. Nonetheless, all tyree were and are eligible as NBCs. If you were not making your argument on behalf of Trump using this issue, we would not be arguing. Thus, you are projecting your own shortcoming on me. AND, that is really bunk.

The statute in force when Obozo was born would not have allowed Comrade Stanley Anne to pass her citizenship to Obozo at birth because a female had to be 21 to do so and she was not yet 21 and Obama the Elder was a Brit citizen only. No court would uphold that distinction as to Stanley Anne’s disability by age and gender as rational. Congress has no authority to “naturalize” a NBC, Article I, Section 8’s language notwithstanding since that language provides only for Congress to make uniform rules for “naturalization.” That does not apply to NBCs who are not subject to “naturalization.”

Because he doesn’t want to? Because releasing it to the general public won’t help?

Because you don’t get a birth certificate? After filing the CRBA you get a Consular Report of Birth Abroad. Which is a form you get back that certifies their birth and their citizenship.

Maybe he’s really an alien and came here to take over? Thats about as likely as all of your conjecture.
