Former House Majority Leader Tom DeLay told Newsmax TV on Wednesday that Ted Cruz might ultimately "end up in the courts" on the question of his citizenship and how it might affect his presidential campaign. "I've had this problem ever since Cruz announced," DeLay, the five-term Texas Republican who served from 2003 to 2005, told "The Steve Malzberg Show" in an interview.
"There is a difference between the definition of natural born and naturalization â and it has not been settled by any branch of government. "Cruz needs to address this in some way because it is a cloud right now in Iowa," DeLay said. [...]
DeLay, however, told Malzberg that the "most expedient" way for Cruz to settle any questions is to work through the courts. "You can't do anything through Congress," he said. "Congress isn't going to pass any bill to protect him â and I'm sure [President Barack] Obama wouldnât sign anything. "He's going to the courts if he's the nominee. The Democrats will use every avenue available to them.
"They sued me over a valid issue," DeLay said, referring to a 2006 lawsuit brought by Democrats after he dropped his re-election bid. "They'll sue him. "He'll end up in the courts one way or another."

I used to want it to be settled by the courts.
Then I thought it would be best if was settled by Congress.
Now I’ve reached the point where I want it settled by the sovereign people of the United States. It’s our Constitution and our country.
And if Obama should have taught us anything, it’s that we need the strictest definition of the natural born requirement for the office that includes the powers of the Commander-in-Chief.

Having an American mother might make you American, but not a natural born citizen.
Under natural law, the conditions of the children follow the condition of the father, not the mother.
The purpose of Article II, section 1, paragraph 5 was to guarantee full and unquestionable unencumbered allegiance to the United States by any and every POTUS. a non citizen parent would not be consistent with that intent. you could not convince me that a child born of an alien parent would have full, unquestionable, unencumbered allegiance to this country. I have seen to many hyphenated Americans waving the flags of their fathers in the streets of America to ever accept such a notion.

Cruz would do well to have this issue settled by the courts as soon as possible. It will not go away on it’s own and will probably deter a lot of support he might otherwise enjoy.
The Act's NBC clause would only be unconstitutional if it was meant to be used as a redefinition.
If it was meant to be a simple codification of the common law definition of NBC then it wasn't.
