I want to be clear:

Ginsburg believes that you don’t need Jus Soli. Now, I haven’t checked to see if Ginsburg’s grandson has two citizen parents. I do know that she thinks her grandson born in France can run for POTUS.

SO all of these Freepers are siding with that side of SCOTUS. Not Scalia’s side who has indicated he might rule in favor of Jus Soli.

And if one reads the constitution, it is purely jus soli - Art IV, Sec. 2 and 14th amendment. Those parts of the constitution define NBC to the extent that they establish that born-abroad, at the place the parents reside, isn't NBC, it is naturalized.

It will be tricky to convert jus soli into jus sanguinas, and it's impossible to do so for Cruz (intellectually honestly) using a textual analysis of the constitution, and in light of Rogers v. Bellei and assorted other precedents.

I agree with you that SCOTUS is a crap shoot. Might as well toss a coin. They pick the outcome they want, and cherry pick law to get the result.

What a nightmare. If anyone had told me conservatives would no longer demand a US birth certificate of their POTUS candidates, I would have laughed them out of the room.
