Vanity: Would Ted Cruz Be Eligible For POTUS During The Time Of Our Founding Fathers

Based on the current knowledge of Ted Cruz's citizenship, would Ted Cruz be considered eligible for the presidency at the time of our Founding Fathers (1788 - 1840).

Facts About Ted Cruz:
1) Mother was U.S. Citizen
2) Father was a foreign Citizen
3) Born in Foreign Country (Canada was a British Colony at the time)
4) Held Dual Citizenship



On July 25, 1787, John Jay wrote to George Washington, presiding officer of the Convention:

Permit me to hint, whether it would not be wise and seasonable to provide a strong check to the admission of Foreigners into the administration of our national Government, and to declare expressly that the Command in chief of the American army shall not be given to, nor devolve on, any but a natural born Citizen.

While the Committee on Detail originally proposed that the President must be merely a citizen as well as a resident for 21 years, the Committee of Eleven changed "citizen" to "natural born citizen" without recorded explanation after receiving Jay's letter. The Convention accepted the change without further recorded debate.

I have maintained all along that U.S. Senator Cruz is completely and totally Constitutionally eligible to hold our nation’s highest office.

I have also Tweeted to Mr. Donald Trump to please abandon this topic.

I proposed a question that is based on the intent and wisdom and the Founding Fathers and our Constitution, and I’m criticized and threatened for such a positioned.

Your premise is so flawed as to be a joke. Anyone who was a citizen at the time the Constitution was ratified was eligible. If Ted Cruz were alive at that time then he would have been eligible even under your silly theory that he isn't now.

Since you posted that, there have been 4 new articles posted on whether or not Cruz is a NBC.

It is not "just a sidebar". It is now the central focus of this forum.

The point was that, at that time, an individual born outside the limits of the United States to an alien father would not have been a citizen at all.

Thank you, Jim. I support Trump, but if Cruz is the nominee, I have no qualms voting him. I just think that the question is valid to discuss. My opinion of his eligibility isn’t going to change his eligibility. Just the same as my opinion of Obama’s eligibility isn’t going to change that he was elected into office.

Do you not comprehend that the very use of the word “naturalization” means that an action other than birth is required? Natural born citizens have no need for that at all.

Your question is certainly appropriate for this constitutional-loving site.

I just so much don’t want tyrants to win because they successfully use this to keep our focus on these points, which are legitimate.

Right now this country is in so much jeopardy, I think we just need to focus on winning first, then educating the populace about the constitution.

If it was a US territory, there would have been some basis to claim US jurisdiction, but the alien father would still have been a problem at that time. Citizenship followed the father. His wife derived her citizenship from his, as did his children. That’s just how it was.

Yes, and the US constitution MAY have been better for it. There are new amendments to the constitution that folks would like to make in a constitutional convention such as “Marriage is between one PERSON BORN A MAN and one PERSON BORN A WOMAN” and “The right to bear arms applies to individuals whether in their homes or elsewhere”. The reason they weren’t explicitly in the original constitution was because the founders could not envision the insanity afflicting our nation today. Ted Cruz knows the insanity afflicting us today and he has first-hand knowledge of it as the insanity has been used against him personally.

Yes, and possibly Donald Trump also. If Trump had had a hand in writing the constitution, it would say things such as “It’s gonna be great!” & “I’m gonna make it happen” & “George Washington can NOT be President because he served in the British Army - but I can because I built some inns that profited from the British Army occupation”.
