Eleanor Darragh, mother of Sen. Ted Cruz (R-TX) 97% , was born in Delaware on Nov. 23, 1934, establishing her citizenship by birth-and, according to U.S. law, that of her son, even though he was born in Calgary, Alberta, Canada, on Dec. 22, 1970.

The Cruz for President campaign provided Breitbart News exclusively with the birth certificate.

His mom’s naturalization papers are on WND.

For anybody interested in citizenship of foreign-born children of citizens, the case you note, Rogers v. Bellei, 401 U.S. 815 (1971), is a must read.

I shake my head as I read through FR. So little informed opinion, so much invective, smoke, fury, signifying nothing. [should go without saying, not referring to you]

Thanks for pointing readers to the case.

Precedent setting decisions only mean something until the next precedent decision. Which is an indictment of that whole concept.

His mom's naturalization papers are on WND.

So then Trump must think that only one citizen parent is required to make an NBC since he has only documented his Mom.

I think every candidate should get all relevant paperwork out to the public. The media permitting Obama to hide his identity has left a very bad impression on me. I don’t want easily answered, stupid nagging questions to be out there. It’s too easy.

Where does privacy begin? Not with ANYTHING having anything to do with elibibility for the office.

Military records should be open.
Licenses and certifications and the like should be open.

State department refused to acknowledge Jerusalem as Israel, if I recall correctly. The CRBA is like having an AKC dog and not registering it. It is a purebred, but you’re not in the club.

No need. He has proven beyond any doubt whatsoever that he is a citizen. Requiring anything else reflects very poorly on the requester. It is voyeuristic and shows extreme bias.

Actually the 1790 law was rewritten in 1795 and it excludes the words natural born.

He has the right to invest or not invest where he wants. It sounds like you are for fascism, government control of private businesses.

Marbury was decided on the basis of jurisdiction and superiority in a "conflict of law" situation. SCOTUS concluded that the Constitution was superior to a statute that was in conflict with the constitution, and that SCOTUS lacked jurisdiction to hear the case, said jurisdiction being a grant from the constitution.

Marbury has since been claimed to stand for the broad position that SCOTUS is empowered by the constitution to say what the law is. Marbury v. Madison is the most cited case is all of US jurisprudence, and it almost invariably misrepresented.

So, you are an American citizen. Well, I am more American than you are - I am 1/16 Choctaw Indian and the rest English. Now, the Indians were here before the Europeans came, so my 1/16 Indian makes me more American than any of you come lately sects from other countries.

Can we start a race war over who is more American than someone else? That sounds like what this thread is deteriorating to - a ridiculous thread in the first place, wanting birth certificates to prove what does not need to be proved. Anyway, as an Indian, I will hold a war council and decide whether or not I need to go to war. :o)

I have to say - if Obama’s BC looked like this no one would have doubted his status.

The law was rewritten solely to extend the amount of time resident before one could be naturalized. No discussion of natural born is recorded that I know of and is irrelevant since the original intent of the First Congress is evident in the first Naturalization Act.

There are only two types of citizens. Naturalized or natural born. That’s it.If you have not been naturalized and you are a citizen.... Well guess what?

Actually, no, it doesn’t. It shows transparency to release it. And the application itself for a CRBA shows intent of the family at the time.

So, there’s excellent reason for releasing it.
